حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عُبَيْدِ اللَّهِ، قَالَ حَدَّثَنِي نَافِعٌ، عَنْ عَبْدِ اللَّهِ ـ رضى الله عنه ـ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنِ الشِّغَارِ. قُلْتُ لِنَافِعٍ مَا الشِّغَارُ قَالَ يَنْكِحُ ابْنَةَ الرَّجُلِ وَيُنْكِحُهُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ، وَيَنْكِحُ أُخْتَ الرَّجُلِ وَيُنْكِحُهُ أُخْتَهُ بِغَيْرِ صَدَاقٍ. وَقَالَ بَعْضُ النَّاسِ إِنِ احْتَالَ حَتَّى تَزَوَّجَ عَلَى الشِّغَارِ، فَهْوَ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ فِي الْمُتْعَةِ النِّكَاحُ فَاسِدٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ بَعْضُهُمُ الْمُتْعَةُ وَالشِّغَارُ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ.
English Translation
Hadrat Abdullah bin Umar (may Allah be well pleased with them both) narrates that the Beloved Messenger of Allah (blessings and peace of Allah be upon him) forbade the Shighar marriage. I asked Nafi' (may the mercy of Allah be upon him): 'What is Shighar?' He said: 'It is when a man marries another's daughter without mahr, and in exchange the other marries his daughter without mahr; or a man gives his sister in marriage and the other gives his sister in marriage, both without mahr.' Some people say: If one plays a trick and marries on the basis of Shighar, the marriage is valid but the condition is void. Regarding Mut'a, they say the marriage is invalid and the condition is void. Others say: Both Mut'a and Shighar are valid, but the condition is void.
Urdu Translation
حضرت عبداللہ بن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے نکاحِ شغار سے منع فرمایا۔ میں نے نافع رحمۃ اللہ تعالیٰ علیہ سے پوچھا: شغار کیا ہے؟ انہوں نے فرمایا: یہ کہ ایک شخص بغیر مہر کے دوسرے کی لڑکی سے نکاح کرے اور اس کے بدلے دوسرا بغیر مہر کے اس کی لڑکی سے نکاح کرے، یا ایک اپنی بہن دے اور دوسرا بغیر مہر کے اپنی بہن دے۔ بعض لوگ کہتے ہیں: اگر حیلہ کر کے شغار کی بنیاد پر نکاح کر لیا جائے تو نکاح جائز ہے اور شرط باطل ہے۔ اور متعہ کے بارے میں کہا: نکاح فاسد ہے اور شرط بھی باطل ہے۔ اور بعض کہتے ہیں: متعہ اور شغار دونوں جائز ہیں اور شرط باطل ہے۔
