حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا عَبْدُ الْوَاحِدِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ قَالَ قَضَى النَّبِيُّ صلى الله عليه وسلم بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلاَ شُفْعَةَ.
English Translation
It is narrated by Hadrat Jabir bin Abdullah (may Allah be well pleased with them both) who said: The Noble Prophet (blessings and peace of Allah be upon him) ruled that the right of pre-emption applies to every jointly owned property that has not yet been divided. Once the boundaries are fixed and the pathways are separated, then there is no right of pre-emption.
Urdu Translation
حضرت جابر بن عبداللہ رضی اللہ تعالیٰ عنہما سے روایت ہے، انہوں نے فرمایا: نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ہر اس مشترکہ جائیداد میں شفعہ کا حق دیا جس کی تقسیم نہ ہوئی ہو۔ جب حد بندی ہو جائے اور راستے الگ ہو جائیں تو پھر شفعہ کا حق نہیں رہتا۔
