حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى عَنِ الْمُزَابَنَةِ قَالَ وَالْمُزَابَنَةُ أَنْ يَبِيعَ الثَّمَرَ بِكَيْلٍ، إِنْ زَادَ فَلِي وَإِنْ نَقَصَ فَعَلَىَّ. قَالَ وَحَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم رَخَّصَ فِي الْعَرَايَا بِخَرْصِهَا.
English Translation
It is narrated from Hadrat Ibn Umar (may Allah be well pleased with them both) that the Noble Prophet (blessings and peace of Allah be upon him) forbade Muzabana. He (the narrator) says: Muzabana is that one sells fruit by measure (estimation) saying: If it turns out to be more, it is mine, and if less, it is on me. He further narrates: And Hadrat Zaid bin Thabit (may Allah be well pleased with him) informed me that the Noble Prophet (blessings and peace of Allah be upon him) granted permission for the sale of Araya (gifted palm trees) by estimation.
Urdu Translation
حضرت ابن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے مزابنہ سے منع فرمایا۔ فرماتے ہیں: مزابنہ یہ ہے کہ پھل (اندازے سے) ناپ کر بیچے اور کہے کہ اگر زیادہ ہو تو میرا ہے اور اگر کم ہو تو میرے ذمے ہے۔ فرماتے ہیں: اور مجھ سے حضرت زید بن ثابت رضی اللہ تعالیٰ عنہ نے بیان کیا کہ نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے عرایا (ہبہ کیے گئے درخت) کو اندازے سے بیچنے کی اجازت مرحمت فرمائی۔
