حَدَّثَنا مُحَمَّد بن مسكين حَدَّثَنا عثمان بن صالح حَدَّثَنِي بكر بن مضر عن عمرو بن دينار قال قال طاوس عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قتل في عميا بحجر أو عصا فهو خطأ عقله عقل خطأ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوْدٌ وَمَنْ حَالَ دونه فعليه لعنة الله وغضبه لا يُقْبَلُ مِنْهُ صَرْفٌ وَلا عَدْلٌوَهَذَا الحديثُ قد رواه سُلَيْمَانُ بْنُ كَثِيرٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَامجاهد عنه اللهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قتل في عميا بحجر أو عصا فهو خطأ عقله عقل خطأ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوْدٌ وَمَنْ حَالَ دونه فعليه لعنة الله وغضبه لا يُقْبَلُ مِنْهُ صَرْفٌ وَلا عَدْلٌوَهَذَا الحديثُ قد رواه سُلَيْمَانُ بْنُ كَثِيرٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَامجاهد عنه
English Translation
Muhammad ibn Miskin narrated to us, Uthman ibn Salih narrated to us, Bakr ibn Mudar narrated to me, from Amr ibn Dinar who stated: Tawus said, from Hadrat Abu Hurairah (may Allah be well pleased with him), from the Noble Prophet (blessings and peace of Allah be upon him) who stated: «Whoever is killed in a confused fight — by a stone or a stick — it is an accidental killing, and his blood money is the blood money of accidental killing. Whoever is killed deliberately, it is retaliation. Whoever intervenes to prevent it, upon him is the curse of Allah and His wrath; neither obligatory nor supererogatory deeds will be accepted from him.» This hadith was also narrated by Sulaiman ibn Kathir from Amr ibn Dinar from Tawus from Ibn Abbas (may Allah be well pleased with them).
