حَدَّثنا مُحَمَّدُ بْنَ الْمُثَنَّى قَال حَدَّثنا مُحَمد بْنُ أَبِي عَدِيّ عَن سَعِيد بْنِ أَبِي عَرُوبة عَنْ قَتَادَةَ عَن الْحَسَنِ عَنْ سَمُرة رَضِي اللَّهُ عَنْهُ عَنِ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم قَالَ مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضٍ فَهِيَ لَهُوَهَذَا الْحَدِيثُ لا نَعْلَمُ رَوَاهُ عَنِ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم إلاَّ سَمُرَةُوَمَعْنَاهُ عِنْدَنَا أَنَّهُ مَنْ أَحَاطَ عَلَى أَرْضٍ حَائِطًا فَهِيَ لَهُ إِذَا كَانَتِ الأَرْضُ لَمْ يَمْلِكْهَا أَحَدٌ فَصَارَتْ لَهُ لأَنَّهُ سَبَقَ إِلَيْهَا مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضٍ فَهِيَ لَهُوَهَذَا الْحَدِيثُ لا نَعْلَمُ رَوَاهُ عَنِ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم إلاَّ سَمُرَةُوَمَعْنَاهُ عِنْدَنَا أَنَّهُ مَنْ أَحَاطَ عَلَى أَرْضٍ حَائِطًا فَهِيَ لَهُ إِذَا كَانَتِ الأَرْضُ لَمْ يَمْلِكْهَا أَحَدٌ فَصَارَتْ لَهُ لأَنَّهُ سَبَقَ إِلَيْهَا
English Translation
Narrated Samurah (may Allah be pleased with him) from the Prophet (peace and blessings of Allah be upon him) who said: 'Whoever encloses a piece of land with a wall, it belongs to him.' This hadith, we do not know it narrated from the Prophet (peace and blessings of Allah be upon him) except by Samurah. Its meaning, in our view, is that whoever encloses land with a wall, it belongs to him if the land was not previously owned, and it becomes his because he was the first to claim it.
