حَدَّثنا إبراهيم بن زياد البغدادي قَال حَدَّثنا عَاصِم بن علي قَال حَدَّثنا أَبُو الأَحْوَصِ عَنْ سِمَاك بْنِ حَرْبٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَن أَبيهِ رَضِي اللَّهُ عَنْهُ قَالَ جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم فَقَالَ الْحَضْرَمِيُّ يَا رَسولَ اللهِ إِنَّ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي وَفِي يَدِي لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم لِلْحَضْرَمِيِّ أَلَكَ بَيِّنَةٌ قَالَ مالي بَيِّنَةٌ قَالَ يَحْلِفُ قَالَ إِذًا يَحْلِفُ مَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ قَالَ لَيْسَ لَكَ إلاَّ ذَلِكَ ثُمَّ قَالَ رَسُول اللهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم مَنْ حَلَفَ عَلَى مَالِ أَخِيهِ فَأَكَلَهُ ظُلْمًا لَقِيَ اللَّهَ وهُو عَنْهُ مُعْرِضٌ اللَّهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم فَقَالَ الْحَضْرَمِيُّ يَا رَسولَ اللهِ إِنَّ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي وَفِي يَدِي لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم لِلْحَضْرَمِيِّ أَلَكَ بَيِّنَةٌ قَالَ مالي بَيِّنَةٌ قَالَ يَحْلِفُ قَالَ إِذًا يَحْلِفُ مَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ قَالَ لَيْسَ لَكَ إلاَّ ذَلِكَ ثُمَّ قَالَ رَسُول اللهِ صَلَّى اللَّهُ عَلَيه وَسَلَّم مَنْ حَلَفَ عَلَى مَالِ أَخِيهِ فَأَكَلَهُ ظُلْمًا لَقِيَ اللَّهَ وهُو عَنْهُ مُعْرِضٌ
English Translation
Ibrahim ibn Ziyad al-Baghdadi narrated to us, he said: Asim ibn Ali narrated to us, he said: Abu al-Ahwas narrated to us from Simak ibn Harb from Alqama ibn Wa'il from his father (may Allah be pleased with him) who said: A man from Hadramawt and a man from Kinda came to the Messenger of Allah (peace and blessings of Allah be upon him). The Hadrami said: "O Messenger of Allah, this man has seized land that belonged to my father." The Kindi said: "It is my land, in my possession; he has no right to it." The Prophet (peace and blessings of Allah be upon him) said to the Hadrami: "Do you have evidence?" He said: "I have no evidence." He said: "Then his oath." He said: "He will swear - he does not care what he swears upon; he has no scruples about anything." He said: "You have nothing but that." Then the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever swears upon his brother's property and consumes it unjustly will meet Allah while He is turning away from him."
