حَدَّثنا العباس بن عَبد الله قَال حَدَّثنا يَحْيَى بْنُ يَعْلَى بْنِ الْحَارِثِ الْمُحَارِبِيُّ عَن أَبيهِ عَن عَلْقَمَةَ بْنِ مَرْثَدٍ عَن ابْنِ بُرَيدة عَن أَبيهِ رَضِي اللَّهُ عَنْهُ قَالَ جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيّ صَلَّى الله عَلَيه وَسَلَّم فردده ثُمَّ قَالَ اسْتَنْكِهُوهُ فَاسْتَنْكَهُوهُ ثُمَّ رَجَمَهُوَلا نَعْلَمُ يُرْوَى عَن النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم أَنَّه قَالَ اسْتَنْكِهُوهُ إلاَّ فِي حَدِيثِ يَحْيَى بْنِ يَعْلَى بْنِ الْحَارِثِ صَلَّى الله عَلَيه وَسَلَّم فردده ثُمَّ قَالَ اسْتَنْكِهُوهُ فَاسْتَنْكَهُوهُ ثُمَّ رَجَمَهُوَلا نَعْلَمُ يُرْوَى عَن النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم أَنَّه قَالَ اسْتَنْكِهُوهُ إلاَّ فِي حَدِيثِ يَحْيَى بْنِ يَعْلَى بْنِ الْحَارِثِ
English Translation
Al-Abbas ibn Abdullah narrated to us, he said: Yahya ibn Ya'la ibn al-Harith al-Muharibi narrated to us from his father from Alqama ibn Marthad from Ibn Burayda from his father (may Allah be pleased with him) who said: Ma'iz ibn Malik came to the Prophet (peace and blessings of Allah be upon him), who turned him away. Then he said: "Smell his breath." So they smelled his breath [to check for intoxication], then he stoned him. We do not know it to be narrated from the Prophet (peace and blessings of Allah be upon him) that he said "Smell his breath" except in the hadith of Yahya ibn Ya'la ibn al-Harith.
