أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ عَنِ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ قَالَ جَاءَ كِتَابٌ مِنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ إِلَى أَبِي وَهُوَ بِمِنًى أَنْ لَا تَأْخُذْ مِنَ الْخَيْلِ وَلَا مِنَ الْعَسَلِ صَدَقَةً قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَسَعْدُ بْنُ أَبِي ذُبَابٍ يَحْكِي مَا يَدُلُّ عَلَى أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَأْمُرْهُ بِأَخْذِ الصَّدَقَةِ مِنَ الْعَسَلِ وَأنَّهُ شَيْءٌ رَآهُ فَتَطَوَّعَ لَهُ بِهِ أَهْلُهُ قَالَ الزَّعْفَرَانِيُّ قَالَ أَبُو عَبْدِ اللهِ الشَّافِعِيُّ الْحَدِيثُ فِي أَنَّ فِي الْعَسَلِ الْعُشْرَ ضَعِيفٌ وَفِي أَنْ لَا يُؤْخَذَ مِنْهُ الْعُشْرُ ضَعِيفٌ إِلَّا عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَاخْتِيَارِي أنَّهُ لَا يُؤْخَذُ مِنْهُ لِأَنَّ السُّنَنَ وَالْآثَارَ ثَابِتَةٌ فِيمَا يُؤْخَذُ مِنْهُ وَلَيْسَتْ فِيهِ ثَابِتَةٌ فَكَأنَّهُ عَفْوٌ
English Translation
Abu Sa'id ibn Abi 'Amr narrated to us... that al-Shafi'i narrated from Malik, from 'Abdullah ibn Abi Bakr, who said: A letter came from 'Umar ibn 'Abd al-'Aziz to my father while he was at Mina: 'Do not take charity from horses nor from honey.' Al-Shafi'i (may Allah have mercy on him) said: 'Sa'd ibn Abi Dhubab narrates what indicates that the Messenger of Allah (peace be upon him) did not command him to take charity from honey, and that it was something he proposed and the people voluntarily gave.' Al-Za'farani said: Abu 'Abdullah al-Shafi'i said: The hadith regarding honey being subject to the tithe is weak, and the one stating that the tithe should not be taken from it is also weak - except from 'Umar ibn 'Abd al-'Aziz. My preference is that it should not be taken from it, because the established Sunnahs and reports are firmly established regarding what is taken, but are not firmly established regarding honey, so it is as if it is exempted.
