وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ ثنا أَبُو عَامِرٍ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ أَخْبَرَنِي أَبُو عُمَرَ وَهُوَ الْأَوْزَاعِيُّ أَنَّ ابْنَ شِهَابٍ الزُّهْرِيَّ قَالَ مَضَتِ السُّنَّةُ فِي زَكَاةِ الزَّيْتُونِ أَنْ تُؤْخَذَ مِمَّنْ عَصَرَ زَيْتُونَهُ حِينَ يَعْصِرُهُ فِيمَا سَقَتِ السَّمَاءُ وَالْأَنْهَارُ أَوْ كَانَ بَعْلًا الْعُشْرُ وَفِيمَا سُقِيَ بِرِشَاءِ النَّاضِحِ نِصْفُ الْعُشْرِ 7456 قَالَ وَحَدَّثَنَا الْوَلِيدُ أَخْبَرَنِي عُثْمَانُ بْنُ عَطَاءٍ عَنْ أَبِيهِ عَطَاءٍ الْخُرَاسَانِيِّ أَنَّ عُمَرَ بْنَ الْخَطَّابِ لَمَّا قَدِمَ الْجَابِيَةَ رَفَعَ إِلَيْهِ أَصْحَابُ رَسُولِ اللهِ ﷺ أَنَّهُمُ اخْتَلَفُوا فِي عُشْرِ الزَّيْتُونِ فَقَالَ عُمَرُ فِيهِ الْعُشْرُ إِذَا بَلَغَ خَمْسَةَ أَوْسُقٍ حَبُّهُ عَصَرَهُ وَأَخَذَ عُشْرَ زَيْتِهِ حَدِيثُ عُمَرَ ؓ فِي هَذَا الْبَابِ مُنْقَطِعٌ وَرَاوِيهِ لَيْسَ بِقَوِيٍّ وَأَصَحُّ مَا رُوِيَ فِيهِ قَوْلُ ابْنِ شِهَابٍ الزُّهْرِيِّ وَحَدِيثُ مُعَاذِ بْنِ جَبَلٍ وَأَبِي مُوسَى الْأَشْعَرِيِّ أَعْلَى وَأَوْلَى أَنْ يُؤْخَذَ بِهِ وَاللهُ أَعْلَمُ
English Translation
Abu Bakr ibn al-Harith al-Faqih narrated to us... that Ibn Shihab al-Zuhri said: 'The Sunnah regarding the zakah of olives is that it is taken from those who press their olives at the time they press them: what is watered by rain, rivers, or is un-irrigated, the tithe (one-tenth) is due; and what is watered by bucket and water-wheel, half the tithe is due.' And 'Uthman ibn 'Ata' narrated from his father 'Ata' al-Khurasani that when 'Umar ibn al-Khattab came to al-Jabiyah, the Companions of the Messenger of Allah (peace be upon him) differed regarding the tithe on olives, so 'Umar said: 'The tithe is due on it if its seeds reach five awsuq, and he pressed them and took the tithe of their oil.' The hadith of 'Umar in this chapter is disconnected and its narrator is not strong. The most authentic narration on this is the statement of Ibn Shihab al-Zuhri. The hadith of Mu'adh ibn Jabal and Abu Musa al-Ash'ari is of higher standing and more worthy of being followed. And Allah knows best.
