أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا أَبُو إِسْحَاقَ إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ ثنا أَبُو عَامِرٍ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ ثنا أَبُو عَمْرٍو يَعْنِي الْأَوْزَاعِيَّ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ خَفِّفُوا عَلَى النَّاسِ فِي الْخَرْصِ فَإِنَّ فِيهِ الْعَرِيَّةَ وَالْوَطِيَّةَ وَالْأَكَلَةَ قَالَ الْوَلِيدُ قُلْتُ لِأَبِي عَمْرٍو وَمَا الْعَرِيَّةُ؟ قَالَ النَّخْلَةُ وَالنَّخْلَتَانِ وَالثَّلَاثُ يَمْنَحُهَا الرَّجُلُ الرَّجُلَ مِنْ أَهْلِ الْحَاجَةِ قُلْتُ فَمَا الْأَكَلَةُ؟ قَالَ أَهْلُ الْمَالِ يَأْكُلُونَ مِنْهُ رُطَبًا فَلَا يُخْرَصُ ذَلِكَ وَيُوضَعُ مِنْ خَرْصِهِ قَالَ قُلْتُ فَمَا الْوَطِيَّةُ؟ قَالَ مَنْ يَغْشَاهُمْ وَيَزُورُهُمْ قَالَ الشَّيْخُ وَهَذَا اللَّفْظُ الَّذِي
English Translation
Abu Bakr ibn al-Harith al-Faqih narrated to us... that the Awza'i reported that 'Umar ibn al-Khattab (may Allah be pleased with him) said: 'Be lenient with the people in the estimation, for in it are the 'ariyyah (gifted trees), the watiyyah (visitors), and the aklah (what the owners eat).' Al-Walid said: I asked Abu 'Amr: What is the 'ariyyah? He said: One, two, or three palm trees that a man grants to a person in need. I said: What is the aklah? He said: The owners of the property eat ripe dates from it, so that is not estimated and is deducted from the estimation. I said: What is the watiyyah? He said: Those who visit them and come to them.
