وَقَالَ أنا عَبْدُ الْمَجِيدِ عَنِ ابْنِ جُرَيْجٍ قَالَ قَالَ عَطَاءٌ لَيْسَتِ الْمَبْتُوتَةُ الْحُبْلَى مِنْهُ فِي شَيْءٍ إِلَّا أَنَّهُ يُنْفِقُ عَلَيْهَا مِنْ أَجْلِ الْحَبَلِ فَإِذَا كَانَتْ غَيْرَ حُبْلَى فَلَا نَفَقَةَ لَهَا وَاللهُ أَعْلَمُ أَنَّهُ يُنْفِقُ عَلَيْهَا مِنْ أَجْلِ الْحَبَلِ فَإِذَا كَانَتْ غَيْرَ حُبْلَى فَلَا نَفَقَةَ لَهَا وَاللهُ أَعْلَمُ
English Translation
Al-Shafi'i discussed the hadith of Fatimah bint Qays, reconciling it with the Quranic verse about housing divorced women. He concluded that the Prophet granted her permission to relocate due to specific circumstances, not as a general negation of the right to housing.
