أَخْبَرَنَا أَبُو زَكَرِيَّا يَحْيَى بْنُ إِبْرَاهِيمَ بْنِ مُحَمَّدِ بْنِ يَحْيَى نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا الشَّافِعِيُّ أنا مَالِكٌ ح وَأنا أَبُو عَبْدِ اللهِ الْحَافِظُ نا مُحَمَّدُ بْنُ يَعْقُوبَ هُوَ الشَّيْبَانِيُّ نا مُحَمَّدُ بْنُ عَبْدِ السَّلَامِ وَمُحَمَّدُ بْنُ عَمْرٍو قَالَا نا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيَتْرُكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ ﷻ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ وَفِي رِوَايَةِ الشَّافِعِيِّ ثُمَّ لِيُمْسِكْهَا بَدَلَ قَوْلِهِ ثُمَّ لِيَتْرُكْ وَلَمْ يَقُلْ بَعْدُ
English Translation
Nafi' narrated from Ibn Umar that he divorced his wife while she was menstruating during the time of the Messenger of Allah (peace be upon him). Umar ibn al-Khattab (may Allah be pleased with him) asked the Messenger of Allah (peace be upon him) about it. The Messenger of Allah (peace be upon him) said: 'Order him to take her back, then let him keep her until she becomes pure, then menstruates, then becomes pure again. Then if he wishes, he may keep her after that, and if he wishes, he may divorce her before having relations with her. That is the waiting period which Allah the Almighty commanded for the divorce of women.'
