وَأَخْبَرَنَا أَبُو نَصْرٍ أنبأ أَبُو مَنْصُورٍ ثنا أَحْمَدُ ثنا سَعِيدٌ ثنا أَبُو عَوَانَةَ عَنْ أَبِي بِشْرٍ عَنْ طَاوُسٍ وَعَطَاءٍ وَأَهْلِ الْمَدِينَةِ أَنَّهُمْ قَالُوا الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ هُوَ الْوَلِيُّ فَأَخْبَرْتُهُمْ بِقَوْلِ سَعِيدِ بْنِ جُبَيْرٍ هُوَ الزَّوْجُ فَرَجَعُوا عَنْ قَوْلِهِمْ فَلَمَّا قَدِمَ سَعِيدُ بْنُ جُبَيْرٍ قَالَ أَرَأَيْتُمْ إِنْ عَفَا الْوَلِيُّ وَأَبَتِ الْمَرْأَةُ مَا يُغْنِي عَفْوُ الْوَلِيِّ أَوْ عَفَتْ هِيَ وَأَبَى الْوَلِيُّ مَا لِلْوَلِيِّ مِنْ ذَلِكَ
English Translation
Tawus, Ata, and the people of Madinah said: 'The one in whose hand is the marriage tie is the guardian.' Then they were informed of Sa'id ibn Jubayr's view that it is the husband, and they retracted their position. Sa'id ibn Jubayr said: 'Consider - if the guardian forgives and the woman refuses, what good is the guardian's forgiveness? Or if she forgives and the guardian refuses, what does the guardian have to do with it?'
