أَخْبَرَنَا أَبُو الْقَاسِمِ عَبْدُ الْوَاحِدِ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ بْنِ النَّجَّارِ الْمُقْرِئُ بِالْكُوفَةِ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ دُحَيْمٍ ثنا أَحْمَدُ بْنُ حَازِمٍ ثنا عَمْرُو بْنُ حَمَّادٍ عَنْ أَسْبَاطٍ عَنْ سِمَاكٍ عَنْ حَنَشٍ أَنَّ رَجُلَيْنِ اسْتَوْدَعَا امْرَأَةً مِنْ قُرَيْشٍ مِائَةَ دِينَارٍ عَلَى أَنْ لَا تَدْفَعَهَا إِلَى وَاحِدٍ مِنْهُمَا دُونَ صَاحِبِهِ حَتَّى يَجْتَمِعَا فَأَتَاهَا أَحَدُهُمَا فَقَالَ إِنَّ صَاحِبِي تُوُفِّيَ؛ فَادْفَعِي إِلِيَّ الْمَالَ فَأَبَتْ فَاخْتَلَفَ إِلَيْهَا ثَلَاثَ سِنِينَ وَاسْتَشْفَعَ عَلَيْهَا حَتَّى أَعْطَتْهُ ثُمَّ إِنَّ الْآخَرَ جَاءَ فَقَالَ أَعْطِينِي الَّذِي لِي فَذَهَبَ بِهَا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ لَهُ عُمَرُ ؓ هَلْ بَيِّنَةٌ؟ قَالَ هِيَ بَيِّنَتِي فَقَالَ مَا أَظُنُّكِ إِلَّا ضَامِنَةً قَالَتْ أَسْأَلُكَ يَا أَبَا فُلَانٍ أَنْ تَرْفَعَنَا إِلَى ابْنِ أَبِي طَالِبٍ فَأَتَوْهُ وَهُوَ يُطَيِّنُ حَوْضًا لَهُ فِي بُسْتَانٍ وَهُوَ مُتَّزِرٌ بِكِسَاءٍ فَقَصُّوا عَلَيْهِ الْقِصَّةَ فَقَالَ ائْتِنِي بِصَاحِبِكَ وَالِي مَتَاعِكَ
English Translation
Hanash narrated that two men deposited one hundred dinars with a Qurayshi woman on the condition that she would not give them to either one without the other being present. One of them came and said: 'My companion has died, so give me the money.' She refused, but after three years and many intercessors, she gave it to him. Then the other came and said: 'Give me what is mine.' She was taken to Umar ibn al-Khattab, who said to him: 'Do you have proof?' He said: 'She is my proof.' Umar said: 'I think you are liable.' She said: 'I ask you, O Abu so-and-so, to take us to Ibn Abi Talib.' They went to him while he was plastering a pool in his garden, wearing only a cloak. They told him the story, and he said: 'Bring me your companion and my property.'
