أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ قَالَ قَالَ الشَّافِعِيُّ وَقَدْ رُوِيَ فِي تَبْدِيَةِ الدَّيْنِ قَبْلَ الْوَصِيَّةِ حَدِيثٌ عَنِ النَّبِيِّ ﷺ لَا يُثْبِتُ أَهْلُ الْحَدِيثِ مِثْلَهُ قَالَ الشَّافِعِيُّ ثنا سُفْيَانُ عَنْ أَبِي إِسْحَاقَ عَنِ الْحَارِثِ عَنْ عَلِيٍّ عَنِ النَّبِيِّ ﷺ قَضَى بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ قَالَ الشَّيْخُ امْتِنَاعُ أَهْلِ الْحَدِيثِ عَنْ إِثْبَاتِ هَذَا لِتَفَرُّدِ الْحَارِثِ الْأَعْوَرِ بِرِوَايَتِهِ عَنْ عَلِيٍّ ؓ وَالْحَارِثُ لَا يُحْتَجُّ بِخَبَرِهِ لِطَعْنِ الْحُفَّاظِ فِيهِ وَكَذَلِكَ
English Translation
Abu Sa'id ibn Abi Amr informed us with his chain: al-Rabi' narrated: al-Shafi'i said: It has been reported regarding the prioritization of debt before bequest. From Ali, from the Prophet (peace be upon him): He ruled that debt is paid before bequest. The shaykh said: The hadith scholars' reluctance to confirm this is due to al-Harith al-A'war being its sole narrator from Ali, and al-Harith is not used as evidence due to hadith scholars' criticism of him.
