أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ أنا أَبُو مَنْصُورٍ النَّضْرَوِيُّ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا سُفْيَانُ عَنْ ابْنِ طَاوُسٍ عَنْ أَبِيهِ أَنَّهُ كَانَ يَقُولُ إِنَّ الْوَصِيَّةَ كَانَتْ قَبْلَ الْمِيرَاثِ فَلَمَّا نَزَلَ الْمِيرَاثُ نَسَخَ مَنْ يَرِثُ وَبَقِيَتِ الْوَصِيَّةُ لِمَنْ لَا يَرِثُ فَهِيَ ثَابِتَةٌ فَمَنْ أَوْصَى لِغَيْرِ ذِي قَرَابَةٍ لَمْ تَجُزْ وَصِيَّتُهُ
English Translation
Abu Nasr ibn Qatadah informed us with his chain from Ibn Tawus from his father who used to say: The bequest was before inheritance. When the inheritance verses were revealed, they abrogated whoever inherits, and the bequest remained for those who do not inherit. It is established; whoever makes a bequest to non-relatives, his bequest is not valid.
