أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيٍّ الْأَصْبَهَانِيُّ أنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ أنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ الْحَارِثِ ثنا الْحَسَنُ بْنُ عِيسَى أنا ابْنُ الْمُبَارَكِ أنا سَعِيدٌ عَنْ قَتَادَةَ أَنَّ ابْنَ مَسْعُودٍ كَانَ يَجْعَلُ مِيرَاثَهُ كُلَّهُ لِأُمِّهِ فَإِنْ لَمْ تَكُنْ لَهُ أُمٌّ كَانَ لِعَصَبَتِهَا قَالَ وَكَانَ الْحَسَنُ يَقُولُ ذَلِكَ قَالَ وَكَانَ عَلِيٌّ وَزَيْدُ بْنُ ثَابِتٍ ؓ يَقُولَانِ لِأُمِّهِ الثُّلُثُ وَبَقِيَّتُهُ فِي بَيْتِ مَالِ الْمُسْلِمِينَ وَرَوَاهُ مُحَمَّدُ بْنُ بَكْرٍ عَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنْ خِلَاسِ بْنِ عَمْرٍو عَنْ عَلِيٍّ وَزَيْدِ بْنِ ثَابِتٍ ؓ نَحْوَهُ وَالرِّوَايَةُ فِيهِ عَنْ عَلِيٍّ ؓ مُخْتَلِفَةٌ وَقَوْلُهُ مَعَ زَيْدٍ أَشْبَهُ بِمَا ذَكَرْنَا مِنَ السُّنَّةِ الصَّحِيحُ عَنْ عَلِيٍّ مَا مَضَى
English Translation
Ahmad ibn Ali al-Asbahani informed us with his chain from Ibn al-Mubarak from Sa'id from Qatadah that Ibn Mas'ud used to give all his inheritance to his mother, and if he had no mother, it went to her agnates. Al-Hasan held the same view. Ali and Zayd ibn Thabit (may Allah be pleased with them) said: the mother receives a third and the remainder goes to the Muslim public treasury. The reports from Ali on this matter vary, and his agreement with Zayd is more consistent with the authentic Sunnah.
