أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا أَبُو الرَّبِيعِ ثنا فُلَيْحُ بْنُ سُلَيْمَانَ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللهُ فِيهَا مَا ذَكَرَ فِي الْقُرْآنِ مِنَ الْمُتَلَاعِنَيْنِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَجَرَتِ السُّنَّةُ بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا فَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ بَعْدُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللهُ ﷻ لَهَا
English Translation
Abu al-Hasan Ali ibn Muhammad al-Muqri' informed us with his chain from al-Zuhri from Sahl ibn Sa'd al-Sa'idi that a man came to the Messenger of Allah (peace be upon him) and said: 'O Messenger of Allah, what if a man sees another man with his wife - should he kill him, and you would then execute him, or what should he do?' Allah revealed concerning this the verses about mutual imprecation (li'an). The Prophet (peace be upon him) said: 'A ruling has been given regarding you and your wife.' They performed the mutual imprecation in his presence. The man said: 'If I keep her, I have lied about her,' so he divorced her. The practice was established that the couple who perform li'an are separated. She was pregnant and he denied the child, so the child was attributed to her. The practice was then established regarding inheritance that the child inherits from her and she inherits from the child whatever Allah prescribed for her.
