أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ثنا الْحَسَنُ بْنُ عِيسَى أنا ابْنُ الْمُبَارَكِ ح وَأَخْبَرَنَا أَحْمَدُ بْنُ عَلِيٍّ الْحَافِظُ أنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ أنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ الْحَارِثِ الْقَطَّانُ ثنا الْحَسَنُ بْنُ عِيسَى أنا ابْنُ الْمُبَارَكِ أنا يُونُسُ عَنِ الزُّهْرِيِّ قَالَ حَدَّثَنِي سَعِيدُ بْنُ الْمُسَيِّبِ وَعُبَيْدُ اللهِ بْنُ عَبْدِ اللهِ بْنِ عُتْبَةَ وَقَبِيصَةُ بْنُ ذُؤَيْبٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَضَى أَنَّ الْجَدَّ يُقَاسِمُ الْإِخْوَةَ لِلْأَبِ وَالْأُمِّ وَالْإِخْوَةَ لِلْأَبِ مَا كَانَتِ الْمُقَاسَمَةُ خَيْرًا لَهُ مِنْ ثُلُثِ الْمَالِ فَإِنْ كَثُرَتِ الْإِخْوَةُ أُعْطِيَ الْجَدُّ الثُّلُثَ وَكَانَ لِلْإِخْوَةِ مَا بَقِيَ {لِلذَّكَرِ مِثْلُ حَظِّ} [النساء 11] الْأُنْثَيَيْنِ وَقَضَى أَنَّ بَنِي الْأَبِ وَالْأُمِّ أَوْلَى بِذَلِكَ مِنْ بَنِي الْأَبِ ذُكُورِهِمْ وَإِنَاثِهِمْ غَيْرَ أَنَّ بَنِي الْأَبِ يُقَاسِمُونَ الْجَدَّ لِبَنِي الْأَبِ وَالْأُمِّ فَيَرُدُّونَ عَلَيْهِمْ وَلَا يَكُونُ لِبَنِي الْأَبِ مَعَ بَنِي الْأَبِ وَالْأُمِّ شَيْءٌ إِلَّا أَنْ يَكُونَ بَنُو الْأَبِ يَرُدُّونَ عَلَى بَنَاتِ الْأَبِ وَالْأُمِّ فَإِنْ بَقِيَ شَيْءٌ بَعْدَ فَرَائِضِ بَنَاتِ الْأَبِ وَالْأُمِّ فَهُوَ لِلْإِخْوَةِ لِلْأَبِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11]
English Translation
Abu Sa'id ibn Abi Amr informed us: Abu Abdullah Muhammad ibn Ya'qub narrated to us: Muhammad ibn Nasr narrated to us: al-Hasan ibn Isa informed us: Ibn al-Mubarak narrated. And Ahmad ibn Ali the hafiz informed us: Ibrahim ibn Abdullah narrated to us: Isma'il ibn Ibrahim ibn al-Harith al-Qattan narrated to us: al-Hasan ibn Isa narrated to us: Ibn al-Mubarak informed us: Yunus narrated from al-Zuhri who said: Sa'id ibn al-Musayyib, Ubaydullah ibn Abdullah ibn Utbah, and Qabisah ibn Dhu'ayb narrated to me that Umar ibn al-Khattab (may Allah be pleased with him) ruled that the grandfather shares with full and paternal siblings as long as sharing is better for him than a third of the estate. If the siblings are many, the grandfather receives a third and the siblings take the remainder, with the male receiving twice the female's share. He ruled that full siblings have priority over paternal siblings, except that paternal siblings are counted with the grandfather for the benefit of full siblings, and paternal siblings receive nothing alongside full siblings unless they supplement the share of full sisters.
