أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ ثنا يَزِيدُ بْنُ هَارُونَ أنا هِشَامُ بْنُ حَسَّانَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ عَبِيدَةَ السَّلْمَانِيِّ قَالَ كَانَ فِي بَنِي إِسْرَائِيلَ عَقِيمٌ لَا يُولَدُ لَهُ وَكَانَ لَهُ مَالٌ كَثِيرٌ وَكَانَ ابْنُ أَخِيهِ وَارِثَهُ فَقَتَلَهُ ثُمَّ احْتَمَلَهُ لَيْلًا حَتَّى أَتَى بِهِ حَيًّا آخَرِينَ فَوَضَعَهُ عَلَى بَابِ رَجُلٍ مِنْهُمْ ثُمَّ أَصْبَحَ يَدَّعِيهِ عَلَيْهِمْ حَتَّى تَسَلَّحُوا وَرَكِبَ بَعْضُهُمْ إِلَى بَعْضٍ فَقَالَ ذَوُو الرَّأْيِ وَالنَّهْيِ عَلَى مَا يَقْتُلُ بَعْضُكُمْ بَعْضًا وَهَذَا رَسُولُ اللهِ ﷺ فِيكُمْ فَأَتَوْهُ فَقَالَ {إِنَّ اللهَ يَأْمُرُكُمْ أَنْ تَذْبَحُوا بَقَرَةً قَالُوا أَتَتَّخِذُنَا هُزُوًا قَالَ أَعُوذُ بِاللهِ أَنْ أَكُونَ مِنَ الْجَاهِلِينَ} [البقرة 67] قَالَ فَلَوْ لَمْ يَعْتَرِضُوا الْبَقَرَ لَأَجْزَأَتْ عَنْهُمْ أَدْنَى بَقَرَةٍ وَلَكِنَّهُمْ شَدَّدُوا فَشُدِّدَ عَلَيْهِمْ حَتَّى انْتَهَوْا إِلَى الْبَقَرَةِ الَّتِي أُمِرُوا بِذَبْحِهَا فَوَجَدُوهَا عِنْدَ رَجُلٍ لَيْسَ لَهُ بَقَرَةٌ غَيْرَهَا فَقَالَ وَاللهِ لَا أَنْقُصُهَا مِنْ مِلْءِ جِلْدِهَا ذَهَبًا فَأَخَذُوهَا بِمِلْءِ جِلْدِهَا ذَهَبًا فَذَبَحُوهَا فَضَرَبُوهُ بِبَعْضِهَا فَقَامَ فَقَالُوا مَنْ قَتَلَكَ؟ قَالَ هَذَا لِابْنِ أَخِيهِ ثُمَّ مَالَ مَيِّتًا فَلَمْ يُعْطَ ابْنُ أَخِيهِ مِنْ مَالِهِ شَيْئًا وَلَمْ يُوَرَّثْ قَاتِلٌ بَعْدَهُ
English Translation
Abu Abdullah al-Hafiz and Abu Sa'id ibn Abi Amr informed us: Abu al-Abbas al-Asamm narrated to us: Yahya ibn Abi Talib narrated to us: Yazid ibn Harun informed us: Hisham ibn Hassan narrated from Muhammad ibn Sirin from Ubaidah al-Salmani who said: Among the Children of Israel, there was a barren man who had no children but had great wealth, and the son of his brother was his heir. He killed him, then carried him at night and placed him at the door of people from another tribe. In the morning, he accused them until they armed themselves and were about to fight each other. Those of wisdom and judgment said: Why should you kill each other when the Messenger of Allah is among you? They went to him and he said: 'Indeed, Allah commands you to slaughter a cow.' They said: 'Do you mock us?' He said: 'I seek refuge in Allah from being among the ignorant' [2:67]. Had they not been particular about the cow, any cow would have sufficed. But they kept asking questions and it was made harder for them, until they reached the specific cow they were commanded to slaughter. They found it with a man who had no other cow. He said: By Allah, I will not sell it for less than its hide filled with gold. They took it for its hide filled with gold, slaughtered it, and struck the dead man with a part of it. He stood up and they asked: Who killed you? He said: This one - pointing to the son of his brother. Then he fell dead again. The nephew was not given anything from his wealth, and no killer was given inheritance after him.
