وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ ثنا يَحْيَى بْنُ آدَمَ ثنا ابْنُ مُبَارَكٍ عَنْ مَعْمَرٍ عَنِ ابْنِ نَجِيحٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ أَنَّ عُمَرَ جَعَلَ التَّحَجُّرَ ثَلَاثَ سِنِينَ فَإِنْ تَرَكَهَا حَتَّى يَمْضِيَ ثَلَاثُ سِنِينَ فَأَحْيَاهَا غَيْرُهُ فَهُوَ أَحَقُّ بِهَا
English Translation
The Prophet (peace be upon him) said: "Whoever cultivates land belonging to someone without his permission has no right to the land, but he is entitled to his expenses." This protects both the landowner and the cultivator.
