حَدَّثَنَا يَزِيدُ أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ وَهُوَ يَسْأَلُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَ نَحْوَ حَدِيثِ ابْنِ إِدْرِيسَ قَالَ وَسَأَلَهُ عَنْ الثِّمَارِ وَمَا كَانَ فِي أَكْمَامِهِ فَقَالَ مَنْ أَكَلَ بِفَمِهِ وَلَمْ يَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَمَنْ وُجِدَ قَدْ احْتَمَلَ فَفِيهِ ثَمَنُهُ مَرَّتَيْنِ وَضَرْبُ نَكَالٍ فَمَا أَخَذَ مِنْ جِرَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللَّهِ مَا نَجِدُ فِي السَّبِيلِ الْعَامِرِ مِنْ اللُّقَطَةِ قَالَ عَرِّفْهَا حَوْلًا فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَهِيَ لَكَ قَالَ يَا رَسُولَ اللَّهِ مَا نَجِدُ فِي الْخَرِبِ الْعَادِيِّ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ.
English Translation
Yazid told us: Muhammad ibn Ishaq informed us, from Amr ibn Shu'ayb, from his father, from his grandfather, who said: I heard a man from Muzayna asking the Prophet, peace and blessings be upon him, and he mentioned something similar to the hadith of Ibn Idris. He said: he asked him about fruit and what is in its husks, and he said, "Whoever eats with his mouth and does not take any away in a fold of his garment owes nothing; but whoever is found to have carried some away owes twice its price and a punitive beating. Whatever is taken from its drying-place, the hand is to be cut off if what is taken reaches the value of a shield." He said, "O Messenger of Allah, what of what we find as a lost item on a frequented road?" He said, "Announce it publicly for a year; if its owner comes [claim it is returned], otherwise it is yours." He said, "O Messenger of Allah, what of what we find in an ancient ruin?" He said, "In that, and in buried treasure, there is a fifth [due]."
