حَدَّثَنَا أَبُو النَّضْرِ وعَبْدُ الصَّمَدِ قَالَا حَدَّثَنَا مُحَمَّدٌ حَدَّثَنَا سُلَيْمَانُ يَعْنِي ابْنَ مُوسَى عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قَتَلَ مُتَعَمِّدًا دُفِعَ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوهُ وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صَالَحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ.
English Translation
Abu al-Nadr and Abd al-Samad said: Muhammad narrated to us, Sulayman - meaning Ibn Musa - narrated from Amr ibn Shu'ayb from his father from his grandfather that the Prophet (peace be upon him) said: "Whoever kills intentionally shall be handed over to the guardians of the slain. If they wish, they may kill him, and if they wish, they may take the blood money, which is thirty hiqqah (three-year-old camels), thirty jadha'ah (four-year-old camels), and forty khalifah (pregnant camels). That is the blood money for intentional killing. Whatever they agree upon in settlement is theirs, and that is the severity of the blood money."
