حَدَّثَنَا يُونُسُ حَدَّثَنَا حَمَّادٌ يَعْنِي ابْنَ زَيْدٍ حَدَّثَنَا أَيُّوبُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَصَابَ أَرْضًا مِنْ يَهُودِ بَنِي حَارِثَةَ يُقَالُ لَهَا ثَمْغٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ مَالًا نَفِيسًا أُرِيدُ أَنْ أَتَصَدَّقَ بِهِ قَالَ فَجَعَلَهَا صَدَقَةً لَا تُبَاعُ وَلَا تُوهَبُ وَلَا تُورَثُ يَلِيهَا ذَوُو الرَّأْيِ مِنْ آلِ عُمَرَ فَمَا عَفَا مِنْ ثَمَرَتِهَا جُعِلَ فِي سَبِيلِ اللَّهِ تَعَالَى وَابْنِ السَّبِيلِ وَفِي الرِّقَابِ وَالْفُقَرَاءِ وَلِذِي الْقُرْبَى وَالضَّعِيفِ وَلَيْسَ عَلَى مَنْ وَلِيَهَا جُنَاحٌ أَنْ يَأْكُلَ بِالْمَعْرُوفِ أَوْ يُؤْكِلَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ مِنْهُ مَالًا قَالَ حَمَّادٌ فَزَعَمَ عَمْرُو بْنُ دِينَارٍ أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ كَانَ يُهْدِي إِلَى عَبْدِ اللَّهِ بْنِ صَفْوَانَ مِنْهُ قَالَ فَتَصَدَّقَتْ حَفْصَةُ بِأَرْضٍ لَهَا عَلَى ذَلِكَ وَتَصَدَّقَ ابْنُ عُمَرَ بِأَرْضٍ لَهُ عَلَى ذَلِكَ وَوَلِيَتْهَا حَفْصَةُ.
English Translation
Yunus told us, Hammad - that is, Ibn Zayd - told us, Ayyub told us, from Nafi', from Ibn Umar, that Umar ibn al-Khattab acquired land from the Jews of Banu Haritha called Thamgh, and he said: "O Messenger of Allah, I have acquired valuable property; I wish to give it in charity." So he made it an endowment that could not be sold, given away, or inherited; it was to be administered by those of sound judgment among the family of Umar. Whatever surplus came from its produce was to be spent in the way of Allah, the Exalted, and on the wayfarer, and for [freeing] slaves, and the poor, and relatives, and the weak; and there was no blame upon whoever administered it if he ate from it in a reasonable manner, or fed a friend from it, without accumulating wealth from it. Hammad said: Amr ibn Dinar claimed that Abdullah ibn Umar used to give gifts from it to Abdullah ibn Safwan. He said: Hafsa gave land of hers in charity on that same basis, and Ibn Umar gave land of his in charity on that same basis, and Hafsa administered it.
