حَدَّثَنَا إِسْحَاقُ أَخْبَرَنِي مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ أَعْتَقَ شِرْكًا فِي عَبْدٍ فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ فَإِنَّهُ يُقَوَّمُ عَلَيْهِ قِيمَةَ عَدْلٍ فَيُعْطَى شُرَكَاؤُهُ حِصَصَهُمْ وَعَتَقَ الْعَبْدُ عَلَيْهِ وَإِلَّا فَقَدْ عَتَقَ مَا عَتَقَ.
English Translation
Ishaq told us, Malik informed me, from Nafi', from Ibn Umar, that the Messenger of Allah, peace and blessings be upon him, said: "Whoever frees his share in a slave, and he has wealth sufficient to cover the price of the slave, then the slave shall be valued at a fair price, his partners given their shares, and the slave shall be freed by him; otherwise, only what has been freed is freed."
