حَدَّثَنَا عَبْد اللَّهِ قَالَ وَجَدْتُ فِي كِتَابِ أَبِي حَدَّثَنَا يَزِيدُ أَخْبَرَنَا شُعْبَةُ عَنْ أَبِي إِسْحَاقَ عَنْ رَجُلٍ مِنْ نَجْرَانَ أَنَّهُ سَأَلَ ابْنَ عُمَرَ فَقَالَ إِنَّمَا أَسْأَلُكَ عَنْ اثْنَتَيْنِ عَنْ الزَّبِيبِ وَالتَّمْرِ وَعَنْ السَّلَمِ فِي النَّخْلِ فَقَالَ ابْنُ عُمَرَ أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ سَكْرَانَ فَقَالَ إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا قَالَ فَجَلَدَهُ الْحَدَّ وَنَهَى عَنْهُمَا أَنْ يُجْمَعَا قَالَ وَأَسْلَمَ رَجُلٌ فِي نَخْلٍ لِرَجُلٍ فَقَالَ لَمْ تَحْمِلْ نَخْلُهُ ذَلِكَ الْعَامَ فَأَرَادَ أَنْ يَأْخُذَ دَرَاهِمَهُ فَلَمْ يُعْطِهِ فَأَتَى بِهِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَمْ تَحْمِلْ نَخْلُهُ قَالَ لَا قَالَ فَفِيمَ تَحْبِسُ دَرَاهِمَهُ قَالَ فَدَفَعَهَا إِلَيْهِ قَالَ وَنَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ.
English Translation
Abdullah said: I found in my father's book: Yazid narrated to us: Shu'bah informed us, from Abu Ishaq, from a man of Najran, that he asked Ibn Umar, saying: I am only asking you about two things: about raisins and dates (mixed together), and about the salam contract (advance payment) for dates on the palm. Ibn Umar said: A drunken man was brought to the Messenger of Allah, peace and blessings be upon him, and he said: I only drank raisins and dates (separately mixed). He said: So he flogged him the prescribed punishment, and forbade combining the two. He said: And a man entered into a salam contract for dates on the palm belonging to another man, and he said: His palm trees did not bear fruit that year, and he wanted to take back his money, but he was not given it, so he brought him to the Messenger of Allah, peace and blessings be upon him, and he said: Did his palm trees not bear fruit? He said: No. He said: Then why are you withholding his money? So he gave it back to him. He said: And the Messenger of Allah, peace and blessings be upon him, forbade the salam contract for dates on the palm before their soundness becomes evident.
