حَدَّثَنَا يَعْقُوبُ قَالَ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ قَالَ وَذَكَرَ مُحَمَّدُ بْنُ مُسْلِمٍ الزُّهْرِيُّ أَنَّ قَبِيصَةَ بْنَ ذُؤَيْبٍ حَدَّثَهُ أَنَّ بِنْتَ سَعِيدِ بْنِ زَيْدِ بْنِ عَمْرِو بْنِ نُفَيْلٍ وَكَانَتْ فَاطِمَةُ بِنْتُ قَيْسٍ خَالَتَهَا وَكَانَتْ عِنْدَ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عُثْمَانَ طَلَّقَهَا ثَلَاثًا فَبَعَثَتْ إِلَيْهَا خَالَتُهَا فَاطِمَةُ بِنْتُ قَيْسٍ فَنَقَلَتْهَا إِلَى بَيْتِهَا وَمَرْوَانُ بْنُ الْحَكَمِ عَلَى الْمَدِينَةِ قَالَ قَبِيصَةُ فَبَعَثَنِي إِلَيْهَا مَرْوَانُ فَسَأَلْتُهَا مَا حَمَلَهَا عَلَى أَنْ تُخْرِجَ امْرَأَةً مِنْ بَيْتِهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا قَالَ فَقَالَتْ لِأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَنِي بِذَلِكَ قَالَ ثُمَّ قَصَّتْ عَلَيَّ حَدِيثَهَا ثُمَّ قَالَتْ وَأَنَا أُخَاصِمُكُمْ بِكِتَابِ اللَّهِ يَقُولُ اللَّهُ عَزَّ وَجَلَّ فِي كِتَابِهِ { إِذَا طَلَّقْتُمْ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ وَأَحْصُوا الْعِدَّةَ وَاتَّقُوا اللَّهَ رَبَّكُمْ لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ إِلَى لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذَلِكَ أَمْرًا } ثُمَّ قَالَ اللَّهُ عَزَّ وَجَلَّ { فَإِذَا بَلَغْنَ أَجَلَهُنَّ } الثَّالِثَةَ { فَأَمْسِكُوهُنَّ بِمَعْرُوفٍ أَوْ سَرِّحُوهُنَّ بِمَعْرُوفٍ } وَاللَّهِ مَا ذَكَرَ اللَّهُ بَعْدَ الثَّالِثَةِ حَبْسًا مَعَ مَا أَمَرَنِي بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فَرَجَعْتُ إِلَى مَرْوَانَ فَأَخْبَرْتُهُ خَبَرَهَا فَقَالَ حَدِيثُ امْرَأَةٍ حَدِيثُ امْرَأَةٍ قَالَ ثُمَّ أَمَرَ بِالْمَرْأَةِ فَرُدَّتْ إِلَى بَيْتِهَا حَتَّى انْقَضَتْ عِدَّتُهَا.
English Translation
Ya'qub told us, my father told us, from Ibn Ishaq, who said: Muhammad ibn Muslim al-Zuhri mentioned that Qabisah ibn Dhu'ayb told him that the daughter of Sa'id ibn Zayd ibn Amr ibn Nufayl - and Fatimah bint Qays was her maternal aunt - was married to Abdullah ibn Amr ibn Uthman, who divorced her three times. So her aunt Fatimah bint Qays sent for her and moved her to her house, while Marwan ibn al-Hakam was governor of Medina. Qabisah said: Marwan sent me to her, and I asked her what led her to bring a woman out of her house before her waiting period had ended. He said: She said, "Because the Messenger of Allah, peace and blessings be upon him, ordered me to do that." He said: Then she related her story to me, then she said, "And I will dispute with you by the Book of Allah. Allah, Mighty and Majestic, says in His Book: {When you divorce women, divorce them for their prescribed waiting period, and count the waiting period, and fear Allah, your Lord. Do not turn them out of their houses, nor should they leave, except that they commit a clear immorality} up to {Perhaps Allah will bring about after that a new situation}." Then Allah, Mighty and Majestic, says: {And when they have reached their term} - the third - {then retain them honorably or release them honorably}. "By Allah, Allah did not mention any detention after the third, along with what the Messenger of Allah, peace and blessings be upon him, ordered me." He said: So I returned to Marwan and informed him of her account, and he said, "The account of a woman, the account of a woman." He said: Then he ordered that the woman be returned to her house until her waiting period ended.
