حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ قَالَ حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ قَالَ حَدَّثَنَا سَعِيدٌ يَعْنِي الْمَقْبُرِيَّ قَالَ سَمِعْتُ أَبَا شُرَيْحٍ الْكَعْبِيَّ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ فَتْحِ مَكَّةَ إِنَّ اللَّهَ عَزَّ وَجَلَّ حَرَّمَ مَكَّةَ وَلَمْ يُحَرِّمْهَا النَّاسُ فَمَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ فَلَا يَسْفِكَنَّ فِيهَا دَمًا وَلَا يَعْضِدَنَّ فِيهَا شَجَرًا فَإِنْ تَرَخَّصَ مُتَرَخِّصٌ فَقَالَ أُحِلَّتْ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِنَّ اللَّهَ أَحَلَّهَا لِي وَلَمْ يُحِلَّهَا لِلنَّاسِ وَهِيَ سَاعَتِي هَذِهِ حَرَامٌ إِلَى أَنْ تَقُومَ السَّاعَةُ إِنَّكُمْ مَعْشَرَ خُزَاعَةَ قَتَلْتُمْ هَذَا الْقَتِيلَ وَإِنِّي عَاقِلُهُ فَمَنْ قُتِلَ لَهُ قَتِيلٌ بَعْدَ مَقَالَتِي هَذِهِ فَأَهْلُهُ بَيْنَ خِيرَتَيْنِ إِمَّا أَنْ يَقْتُلُوا أَوْ يَأْخُذُوا الْعَقْلَ.
English Translation
Yahya ibn Sa'id narrated to us: Ibn Abi Dhi'b narrated to us: Sa'id - meaning al-Maqburi - narrated to us, who said: I heard Abu Shurayh al-Ka'bi say: The Messenger of Allah, peace and blessings be upon him, said on the Day of the Conquest of Makkah, "Allah, Mighty and Majestic, has made Makkah sacred, and it was not people who made it sacred. So whoever believes in Allah and the Last Day, let him not shed blood in it, nor cut down a tree in it. If anyone seeks to make an exception for himself, saying it was permitted to the Messenger of Allah, peace and blessings be upon him - then indeed Allah permitted it to me, and did not permit it to people; and it was only permitted to me for an hour of a day; and its sanctity has now returned as it was yesterday; let those present convey this to those absent. Indeed, you, people of Khuza'ah, killed this slain man, and I am to arrange the blood-money for him. Whoever, after this statement of mine, has one of his kin killed, his family has one of two choices: either they may retaliate, or they may accept the blood-money.'
