حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الرَّازِيُّ قَالَ حَدَّثَنَا سَلَمَةُ بْنُ الْفَضْلِ قَالَ حَدَّثَنِي مُحَمَّدُ بْنُ إِسْحَاقَ عَنِ الْخَطَّابِ بْنِ صَالِحٍ عَنْ أُمِّهِ قَالَتْ حَدَّثَتْنِي سَلَامَةُ بِنْتُ مَعْقِلٍ قَالَتْ كُنْتُ لِلْحُبَابِ بْنِ عَمْرٍو وَلِي مِنْهُ غُلَامٌ فَقَالَتْ لِيَ امْرَأَتُهُ الْآنَ تُبَاعِينَ فِي دَيْنِهِ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ صَاحِبُ تَرِكَةِ الْحُبَابِ بْنِ عَمْرٍو فَقَالُوا أَخُوهُ أَبُو الْيُسْرِ كَعْبُ بْنُ عَمْرٍو فَدَعَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَا تَبِيعُوهَا وَأَعْتِقُوهَا فَإِذَا سَمِعْتُمْ بِرَقِيقٍ قَدْ حَسَبَنِي فَأْتُونِي أُعَوِّضُكُمْ فَفَعَلُوا فَاخْتَلَفُوا فِيمَا بَيْنَهُمْ بَعْدَ وَفَاةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ قَوْمٌ أُمُّ الْوَلَدِ مَمْلُوكَةٌ لَوْلَا ذَلِكَ لَمْ يُعَوِّضْهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهَا وَقَالَ بَعْضُهُمْ هِيَ حُرَّةٌ قَدْ أَعْتَقَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَفِيَّ كَانَ الِاخْتِلَافُ.
English Translation
Ishaq ibn Ibrahim al-Razi narrated to us, he said: Salamah ibn al-Fadl narrated to us, he said: Muhammad ibn Ishaq narrated to me, from al-Khattab ibn Salih, from his mother, who said: Salamah bint Ma'qil narrated to me, she said: I belonged to al-Hubab ibn 'Amr, and I had a son from him. His wife said to me: You will now be sold for his debt. So I went to the Messenger of Allah, peace and blessings be upon him, and mentioned that to him. The Messenger of Allah, peace and blessings be upon him, said: Who is responsible for the estate of al-Hubab ibn 'Amr? They said: His brother, Abu al-Yusr Ka'b ibn 'Amr. So the Messenger of Allah, peace and blessings be upon him, called him and said: Do not sell her, but free her, and if you hear of any slave that has been assessed against me, come to me and I will compensate you. So they did, and afterward they disagreed among themselves after the death of the Messenger of Allah, peace and blessings be upon him. Some people said: The mother of the child (umm walad) is a slave, for had she not been so, the Messenger of Allah, peace and blessings be upon him, would not have compensated them for her. Others said: She is free, for the Messenger of Allah, peace and blessings be upon him, freed her. So the disagreement was about me.
