حَدَّثَنَا عَفَّانُ أَخْبَرَنَا حَمَّادُ بْنُ زَيْدٍ حَدَّثَنَا عَمْرُو بْنُ دِينَارٍ قَالَ سَمِعْتُ الْحَسَنَ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ فَرُفِعَ ذَاكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا لَهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا لَهَا.
English Translation
Affan narrated to us, Hammad ibn Zayd informed us, Amr ibn Dinar narrated to us, who said: I heard al-Hasan, from Salama ibn al-Muhabbiq, that a man had intercourse with his wife's slave-girl, and this was brought to the Prophet (peace and blessings be upon him), who said: "If she consented, then she is his, and he owes her mistress her equivalent; but if he coerced her, then she is free, and he owes her mistress her equivalent."
