حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ قَالَ وَزَعَمَ عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّ مَرْوَانَ وَالْمِسْوَرَ بْنَ مَخْرَمَةَ أَخْبَرَاهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَامَ حِينَ جَاءَهُ وَفْدُ هَوَازِنَ مُسْلِمِينَ فَسَأَلُوا أَنْ يَرُدَّ إِلَيْهِمْ أَمْوَالَهُمْ وَسَبْيَهُمْ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَعِي مَنْ تَرَوْنَ وَأَحَبُّ الْحَدِيثِ إِلَيَّ أَصْدَقُهُ فَاخْتَارُوا إِحْدَى الطَّائِفَتَيْنِ إِمَّا السَّبْيُ وَإِمَّا الْمَالُ وَقَدْ كُنْتُ اسْتَأْنَيْتُ بِكُمْ وَكَانَ أَنْظَرَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِضْعَ عَشْرَةَ لَيْلَةً حِينَ قَفَلَ مِنْ الطَّائِفِ فَلَمَّا تَبَيَّنَ لَهُمْ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَيْرُ رَادٍّ إِلَيْهِمْ إِلَّا إِحْدَى الطَّائِفَتَيْنِ قَالُوا فَإِنَّا نَخْتَارُ سَبْيَنَا فَقَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْمُسْلِمِينَ فَأَثْنَى عَلَى اللَّهِ عَزَّ وَجَلَّ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ أَمَّا بَعْدُ فَإِنَّ إِخْوَانَكُمْ قَدْ جَاءُوا تَائِبِينَ وَإِنِّي قَدْ رَأَيْتُ أَنْ أَرُدَّ إِلَيْهِمْ سَبْيَهُمْ فَمَنْ أَحَبَّ مِنْكُمْ أَنْ يُطَيِّبَ ذَلِكَ فَلْيَفْعَلْ وَمَنْ أَحَبَّ مِنْكُمْ أَنْ يَكُونَ عَلَى حَظِّهِ حَتَّى نُعْطِيَهُ إِيَّاهُ مِنْ أَوَّلِ مَا يُفِيءُ اللَّهُ عَزَّ وَجَلَّ عَلَيْنَا فَلْيَفْعَلْ فَقَالَ النَّاسُ قَدْ طَيَّبْنَا ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّا لَا نَدْرِي مَنْ أَذِنَ مِنْكُمْ فِي ذَلِكَ مِمَّنْ لَمْ يَأْذَنْ فَارْجِعُوا حَتَّى يَرْفَعَ إِلَيْنَا عُرَفَاؤُكُمْ أَمْرَكُمْ فَجَمَعَ النَّاسُ فَكَلَّمَهُمْ عُرَفَاؤُهُمْ ثُمَّ رَجَعُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرُوهُ أَنَّهُمْ قَدْ طَيَّبُوا وَأَذِنُوا هَذَا الَّذِي بَلَغَنِي عَنْ سَبْيِ هَوَازِنَ.
English Translation
Ya'qub told us: The nephew of Ibn Shihab told us, from his uncle, who said: Urwah bin al-Zubayr claimed that Marwan and al-Miswar bin Makhramah informed him that the Messenger of Allah, peace and blessings be upon him, stood up when the delegation of Hawazin came to him as Muslims and asked him to return to them their wealth and their captives. The Messenger of Allah, peace and blessings be upon him, said to them: "With me are those whom you see, and the most beloved speech to me is the most truthful of it. So choose one of the two groups: either the captives or the wealth. I had indeed waited for you" - and the Messenger of Allah, peace and blessings be upon him, had given them the longest wait of ten-odd nights, when he returned from al-Ta'if. When it became clear to them that the Messenger of Allah, peace and blessings be upon him, would not return to them except one of the two groups, they said: "We choose our captives." So the Messenger of Allah, peace and blessings be upon him, stood up among the Muslims, praised Allah, Mighty and Majestic, as He deserves, then said: "Now then, your brothers have come as repentant people, and I have decided to return their captives to them. So whoever among you wishes to do that willingly, let him do so, and whoever among you wishes to keep his share until we give it to him from the first thing Allah, Mighty and Majestic, grants us as spoils, let him do so." The people said: "We have willingly agreed to that for the Messenger of Allah, peace and blessings be upon him." The Messenger of Allah, peace and blessings be upon him, said to them: "We do not know who among you has given permission for that and who has not. So go back until your representatives report your matter to us." So the people gathered and their representatives spoke to them, then they returned to the Messenger of Allah, peace and blessings be upon him, and informed him that they had willingly agreed and given permission. This is what has reached me concerning the captives of Hawazin.
