حَدَّثَنَا حَجَّاجٌ قَالَ ابْنُ جُرَيْجٍ أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ عَنْ هِشَامِ بْنِ يَحْيَى أَخْبَرَهُ أَنَّ عِكْرِمَةَ بْنَ سَلَمَةَ بْنِ رَبِيعَةَ أَخْبَرَهُ أَنَّ أَخَوَيْنِ مِنْ بَنِي الْمُغِيرَةِ أَعْتَقَ أَحَدُهُمَا أَنْ لَا يَغْرِزَ خَشَبًا فِي جِدَارِهِ فَلَقِيَا مُجَمِّعَ بْنَ يَزِيدَ الْأَنْصَارِيَّ وَرِجَالًا كَثِيرًا فَقَالُوا نَشْهَدُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يَمْنَعْ جَارٌ جَارَهُ أَنْ يَغْرِزَ خَشَبًا فِي جِدَارِهِ فَقَالَ الْحَالِفُ أَيْ أَخِي قَدْ عَلِمْتُ أَنَّكَ مَقْضِيٌّ لَكَ عَلَيَّ وَقَدْ حَلَفْتُ فَاجْعَلْ أُسْطُوَانًا دُونَ جِدَارِي فَفَعَلَ الْآخَرُ فَغَرَزَ فِي الْأُسْطُوَانِ خَشَبَةً فَقَالَ لِي عَمْرٌو فَأَنَا نَظَرْتُ إِلَى ذَلِكَ.
English Translation
Hajjaj narrated to us: Ibn Jurayj said: Amr b. Dinar informed me, that Hisham b. Yahya informed him, that Ikrimah b. Salamah b. Rabi'ah informed him, that two brothers of Banu al-Mughirah — one of them had sworn not to drive wood into his wall — met Mujammi' b. Yazid al-Ansari and many other men, and they said, "We bear witness that the Messenger of Allah, peace and blessings be upon him, said: 'A neighbor should not prevent his neighbor from driving wood into his wall.'" The one who had sworn said, "O my brother, I know that judgment has been made against me, and I have sworn an oath, so build a pillar apart from my wall." So the other did that, and drove a peg into the pillar. Amr said to me, "And I myself looked at that."
