حَدَّثَنَا عَبْدُ الرَّزَّاقِ وَمُحَمَّدُ بْنُ بَكْرٍ قَالَا أَنْبَأَنَا ابْنُ جُرَيْجٍ أَخْبَرَنِي ابْنُ شِهَابٍ الزُّهْرِيُّ عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ أَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَقَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّمَا هِيَ قَالَ أَبُو بَكْرٍ لِمَنْ أَعْطَاهَا وَقَالَ عَبْدُ الرَّزَّاقِ لِمَنْ أُعْطِيَهَا وَإِنَّهَا لَا تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَاهَا عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ.
English Translation
Abd al-Razzaq and Muhammad ibn Bakr told us, they said: Ibn Jurayj informed us: Ibn Shihab al-Zuhri informed me, from the hadith of Abu Salamah ibn Abd al-Rahman ibn Awf, from Jabir ibn Abdullah al-Ansari, that he informed him that the Messenger of Allah, peace and blessings be upon him, ruled: whatever man is granted a life-tenancy for himself and his heirs, and it is said to him, "I have given it to you and your heirs as a lifelong gift for as long as any of you remains," then it belongs" — Abu Bakr said: "to the one to whom it was given" and Abd al-Razzaq said: "to the one who was given it" — "and it does not revert to the one who gave it, because he gave it as a gift over which the laws of inheritance now apply."
