حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا ابْنُ أَخِي بْنِ شِهَابٍ عَنْ عَمِّهِ وَقَدْ حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ أَنَّ جَابِرَ بْنَ عَبْدِ اللَّهِ أخْبَرَهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّهُ مَنْ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي يُعْمَرُهَا قَدْ بَتَّهَا مِنْ صَاحِبِهَا الَّذِي أَعْمَرَهَا مَا وَقَعَ مِنْ مَوَارِيثِ اللَّهِ وَحَقِّهِ.
English Translation
Ya'qub told us, the nephew of Ibn Shihab told us, from his uncle - and Abu Salamah ibn Abd al-Rahman had told me - that Jabir ibn Abdullah informed him that the Messenger of Allah, peace and blessings be upon him, ruled that whoever grants a person a life-tenancy gift for himself and his heirs, it belongs permanently to the one to whom it was granted; it is cut off from the one who granted it, as whatever falls under the inheritance laws and rights ordained by Allah.
