حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدٍ، قَالَ كَانَ عُمَرُ بْنُ الْخَطَّابِ يَقُولُ الدِّيَةُ لِلْعَاقِلَةِ وَلاَ تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا حَتَّى قَالَ لَهُ الضَّحَّاكُ بْنُ سُفْيَانَ كَتَبَ إِلَىَّ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا . فَرَجَعَ عُمَرُ . قَالَ أَحْمَدُ بْنُ صَالِحٍ حَدَّثَنَا عَبْدُ الرَّزَّاقِ بِهَذَا الْحَدِيثِ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ عَنْ سَعِيدٍ وَقَالَ فِيهِ وَكَانَ النَّبِيُّ صلى الله عليه وسلم اسْتَعْمَلَهُ عَلَى الأَعْرَابِ .
English Translation
Sa'id narrates that Hadrat Umar ibn al-Khattab (may Allah be well pleased with him) used to say: Blood-money is borne by the paternal relatives (aqilah), and a wife shall not inherit anything from the blood-money of her husband. This continued until Hadrat al-Dahhak ibn Sufyan (may Allah be well pleased with him) informed him: The Beloved Messenger of Allah (blessings and peace of Allah be upon him) wrote to me instructing me to give the wife of Ashyam al-Dibabi a share from the blood-money of her husband. Thereupon Hadrat Umar (may Allah be well pleased with him) withdrew his previous opinion. Ahmad ibn Salih said: Abd al-Razzaq narrated this tradition to us from Ma'mar, from al-Zuhri, on the authority of Sa'id. In this version it also states that the Noble Prophet (blessings and peace of Allah be upon him) had appointed him (al-Dahhak) as governor over the Bedouins.

سعید کہتے ہیں کہ حضرت عمر بن خطاب رضی اللہ تعالیٰ عنہ پہلے فرمایا کرتے تھے: دیت عاقلہ (کنبے والوں) پر ہے، اور عورت اپنے شوہر کی دیت سے کوئی حصہ نہ پائے گی۔ یہاں تک کہ حضرت ضحاک بن سفیان رضی اللہ تعالیٰ عنہ نے انہیں بتایا: رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے مجھے تحریری حکم بھیجا تھا کہ میں اشیم ضبابی کی بیوی کو اس کے شوہر کی دیت میں سے حصہ دلاؤں۔ اس پر حضرت عمر رضی اللہ تعالیٰ عنہ نے اپنے قول سے رجوع فرما لیا۔ احمد بن صالح کہتے ہیں: ہم سے عبدالرزاق نے یہ حدیث معمر سے بیان کی، انہوں نے زہری سے اور انہوں نے سعید سے۔ اس میں یہ بھی ہے کہ نبی اکرم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے انہیں (ضحاک کو) دیہاتیوں پر عامل مقرر فرمایا تھا۔
