Arabic (Original)
حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ، أَخْبَرَنَا سُفْيَانُ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " أَيُّمَا امْرَأَةٍ نَكَحَتْ بِغَيْرِ إِذْنِ مَوَالِيهَا فَنِكَاحُهَا بَاطِلٌ " . ثَلاَثَ مَرَّاتٍ " فَإِنْ دَخَلَ بِهَا فَالْمَهْرُ لَهَا بِمَا أَصَابَ مِنْهَا فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لاَ وَلِيَّ لَهُ " .
English Translation
Umm al-Mu'minin Hadrat Aisha al-Siddiqah (may Allah be well pleased with her) narrates that the Beloved Messenger of Allah (blessings and peace of Allah be upon him) stated: Any woman who marries without the permission of her guardians, her marriage is void — he said it three times. Then if the husband has consummated the marriage, the dowry belongs to her for what he has taken from her. And if they dispute, then the Sultan (ruler) is the guardian of the one who has no guardian.
Urdu Translation
حضرت اُمّ المؤمنین عائشہ صدیقہ رضی اللہ تعالیٰ عنہا فرماتی ہیں کہ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: جو عورت اپنے ولیوں (سرپرستوں) کی اجازت کے بغیر نکاح کرے تو اس کا نکاح باطل ہے — تین مرتبہ فرمایا — پھر اگر شوہر نے اس سے ہم بستری کر لی تو مہر اس عورت کا ہے اس ہم بستری کے بدلے جو اس نے اس سے کی۔ پھر اگر (اولیاء میں) جھگڑا ہو تو سلطان (حاکم) اس کا ولی ہے جس کا کوئی ولی نہ ہو۔
