Ḥadīth | Ṭabarānī (الطبراني) tabarani:5675 حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا الْقَعْنَبِيُّ عَنْ مَالِكٍ وَحَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثنا عَبْدُ اللهِ بْنُ يُوسُفَ أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ أَخْبَرَهُ أَنَّ عُوَيْمِرَ بْنَ أَشْقَرَ الْعَجْلَانِيَّ أَتَى عَاصِمَ بْنَ عَدِيٍّ الْأَنْصَارِيَّ فَقَالَ لَهُ يَا عَاصِمُ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَسَأَلَ عَاصِمٌ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَكَرِهَ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَأَلَ رَسُولَ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ أَتَاهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَطُّ قَدْ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللهِ ﷺ وَهُوَ فِي وَسَطِ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «قَدْ أَنْزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا» فَقَالَ سَهْلٌ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا عُوَيْمِرٌ ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ قَالَ ابْنُ شِهَابٍ «فَكَانَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ»
الترجمة الإنجليزية
Sahl ibn Sa'd al-Sa'idi narrated that 'Uwaymir ibn Ashqar al-'Ajlani came to 'Asim ibn 'Adi al-Ansari and said: "O 'Asim, tell me — if a man finds another man with his wife, should he kill him, and you then execute him? Or what should he do? Ask the Messenger of Allah about this for me, O 'Asim." 'Asim asked the Messenger of Allah, who disliked such questions and criticized them until it became difficult for 'Asim. When 'Asim returned, 'Uwaymir came and asked what the Messenger of Allah said. 'Asim said: "You have not brought me any good; the Messenger of Allah disliked the question." 'Uwaymir said: "By Allah, I will not stop until I ask him." He went to the Messenger of Allah while he was among the people and said: "O Messenger of Allah, what if a man finds another man with his wife — should he kill him, and you execute him? Or what should he do?" The Messenger of Allah said: "A revelation has come down concerning you and your wife. Go and bring her." Sahl said: They performed the mutual cursing (li'an) while I was among the people before the Messenger of Allah. When they finished, 'Uwaymir said: "I would have lied about her if I keep her." He divorced her three times before the Messenger of Allah commanded it. Ibn Shihab said: "That became the precedent for couples who perform li'an."
