Ḥadīth | Ṭabarānī (الطبراني) tabarani:10832 حَدَّثَنَا مُحَمَّدُ بْنُ النَّضْرِ ثنا مُعَاوِيَةُ بْنُ عُمَرَ ثنا أَبُو إِسْحَاقَ الْفَزَارِيُّ ح وَحَدَّثَنَا بِشْرُ بْنُ مُوسَى ثنا الْحُمَيْدِيُّ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ جَمِيعًا عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ الْمَقْبُرِيِّ عَنْ يَزِيدَ بْنِ هُرْمُزَ قَالَ كَتَبَ نَجْدَةُ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنِ الْخُمُسِ لِمَنْ هُوَ؟ وَعَنِ الْعَبْدِ وَالْمَرْأَةِ يَحْضُرَانِ الْمَغْنَمَ هَلْ لَهُمَا مِنْهُ شَيْءٌ؟ وَعَنِ الْيَتِيمِ مَتَى يُرْفَعُ عَنْهُ اسْمُ الْيَتِيمِ؟ وَعَنْ قَتْلِ الْوِلْدَانِ فَقَالَ ابْنُ عَبَّاسٍ لَوْلَا أَنِّي أَرْجُو أَنْ يَنْفَعَهُ اللهُ بِكِتَابِي مَا كَتَبْتُ إِلَيْهِ ثُمَّ قَالَ اكْتُبْ يَا يَزِيدُ أَمَّا الْخُمُسُ فَإِنَّا كُنَّا نَرَى أَنَّهُ لَنَا فَأَبَى عَلَيْنَا قَوْمُنَا ذَلِكَ وَأَمَّا الْعَبْدُ وَالْمَرْأَةُ يَحْضُرَانِ الْمَغْنَمَ فَإِنَّهُ لَيْسَ لَهُمَا مِنْهُ شَيْءٌ وَلَكِنْ يُرْضَخُ لَهُمَا وَأَمَّا الْيَتِيمُ فَإِنَّهُ يُرْفَعُ عَنْهُ الْيُتْمُ إِذَا بَلَغَ الْحُلُمَ وَيَصِيرُ مِنْ فُقَرَاءِ الْمُسْلِمِينَ وَأَمَّا الْوِلْدَانِ فَلَا تَقْتُلْهُمْ حَتَّى تَعْلَمَ مِنْهُمْ مِثْلَ مَا عَلِمَ الْخَضِرُ مِنَ الْغُلَامِ قَبْلَ أَنْ تَقْتُلَهُ وَاللَّفْظُ لِحَدِيثِ أَبِي إِسْحَاقَ الْفَزَارِيِّ
الترجمة الإنجليزية
Ibn Abbas narrated: Najdah wrote to Ibn Abbas asking about the khums — for whom is it, about a slave and a woman who are present at the battle — do they receive a share, about an orphan — when is the name of orphan removed from him, and about killing children. Ibn Abbas said: 'Were it not that I hope Allah will benefit him by my letter, I would not have written to him.' Then he said: 'Write, O Yazid. As for the khums, we used to consider it ours, but our people refused us that. As for a slave and a woman who are present at the battle, they have no fixed share, but they are given a small gift. As for the orphan, the name of orphan is removed from him when he reaches puberty, and he becomes one of the poor Muslims. As for children, do not kill them until you know about them what al-Khidr knew about the boy before he killed him.'
