أَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ قَتَادَةَ أنبأ أَبُو الْحَسَنِ مُحَمَّدُ بْنُ الْحَسَنِ السَّرَّاجُ ثنا أَبُو شُعَيْبٍ الْحَرَّانِيُّ ثنا أَحْمَدُ بْنُ عُبَيْدِ اللهِ الْبَصْرِيُّ الْعَنْبَرِيُّ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا حَبِيبٌ الْمُعَلِّمُ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ أَخَوَيْنِ مِنَ الْأَنْصَارِ كَانَ بَيْنَهُمَا مِيرَاثٌ فَسَأَلَ أَحَدُهُمَا صَاحِبَهُ الْقِسْمَةَ فَقَالَ لَئِنْ عُدْتَ تَسْأَلُنِي الْقِسْمَةَ لَمْ أُكَلِّمْكَ أَبَدًا وَكُلُّ مَالٍ لِي فِي رِتَاجِ الْكَعْبَةِ فَقَالَ عُمَرُ ؓ إِنَّ الْكَعْبَةَ لَغَنِيَّةٌ عَنْ مَالِكَ كَفِّرْ عَنْ يَمِينِكَ وَكَلِّمْ أَخَاكَ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَمِينَ عَلَيْكَ وَلَا نَذْرَ فِي مَعْصِيَةِ الرَّبِّ وَلَا فِي قَطِيعَةِ الرَّحِمِ وَلَا فِيمَا لَا تَمْلِكُ
الترجمة الإنجليزية
Sa'id ibn al-Musayyib reported that two brothers from the Ansar had an inheritance between them. One asked the other to divide it, and the other said: If you ask me again for division, I will never speak to you again, and all my wealth will go to the curtain of the Ka'bah. Umar (may Allah be pleased with him) said: The Ka'bah has no need for your wealth. Make expiation for your oath and speak to your brother, for I heard the Messenger of Allah (peace and blessings be upon him) say: No oath or vow is binding in disobedience to the Lord, in severing ties of kinship, or regarding what you do not own.
