أَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ بْنُ عَلِيٍّ ثنا يَحْيَى بْنُ آدَمَ حَدَّثَنِي عَبْدُ الرَّحِيمِ عَنْ أَشْعَثَ عَنِ الْحَكَمِ عَنْ شُرَيْحٍ أَنَّهُ اشْتَرَى أَرْضًا مِنْ أَرْضِ الْحِيرَةِ يُقَالُ لَهَا زُبَا قَالَ وَقَالَ الْحَكَمُ وَكَانُوا يُرَخِّصُونَ فِي شِرَاءِ أَرْضِ الْحِيرَةِ مِنْ أَجْلِ أَنَّهُمْ صُلْحٌ قَالَ يَحْيَى وَسَأَلْتُ حَسَنَ بْنَ صَالِحٍ فَكَرِهَ شِرَاءَ أَرْضِ الْخَرَاجِ الَّتِي أُخِذَتْ عَنْوَةً فَوُضِعَ عَلَيْهَا الْخَرَاجُ فَلَمْ يَرَ بَأْسًا بِشِرَاءِ أَرْضِ أَهْلِ الصُّلْحِ
الترجمة الإنجليزية
Abu Sa'id informed us from Abu al-Abbas, from al-Hasan ibn Ali, from Yahya ibn Adam, from Abd al-Rahim, from Ash'ath, from al-Hakam, from Shurayh that he purchased land from the land of al-Hirah called Zuba. Al-Hakam said: They used to permit buying land from al-Hirah because they were treaty people. Yahya said: I asked Hasan ibn Salih, and he disliked buying kharaj land that was taken by force and had kharaj imposed on it, but he saw no problem with buying land of treaty people.
