أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ أنبأ أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا هُشَيْمٌ أنبأ مُغِيرَةُ قَالَ كَتَبَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ أَنْ لَا يُبْلَغَ فِي التَّعْزِيرِ أَدْنَى الْحُدُودِ أَرْبَعِينَ سَوْطًا وَقَدْ رُوِيَ عَنِ الصَّحَابَةِ ؓ فِي مِقْدَارِ ذَلِكَ آثَارٌ مُخْتَلِفَةٌ وَأَحْسَنُ مَا يُصَارُ إِلَيْهِ فِي هَذَا مَا ثَبَتَ عَنِ النَّبِيِّ ﷺ

Umar ibn Abd al-Aziz wrote: "The discretionary punishment (ta'zir) should not reach the minimum prescribed punishment — forty lashes." Various reports from the Companions differ on the exact amount. The best approach is what is authentically established from the Prophet (peace be upon him).
