أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ ثنا أَبُو دَاوُدَ ثنا شُعْبَةُ عَنِ الْأَشْعَثِ بْنِ أَبِي الشَّعْثَاءِ قَالَ سَمِعْتُ الْأَسْوَدَ بْنَ يَزِيدَ يَقُولُ قَضَى فِينَا مُعَاذٌ بِالْيَمَنِ فِي رَجُلٍ تَرَكَ ابْنَتَهُ وَأُخْتَهُ فَأَعْطَى الِابْنَةَ النِّصْفَ وَأَعْطَى الْأُخْتَ النِّصْفَ 12331 قَالَ أَبُو دَاوُدَ قَالَ شُعْبَةُ وَأَخْبَرَنِي الْأَعْمَشُ قَالَ سَمِعْتُ إِبْرَاهِيمَ يُحَدِّثُ عَنِ الْأَسْوَدِ بْنِ يَزِيدَ قَالَ قَضَى فِينَا مُعَاذٌ بِالْيَمَنِ أَنَّ رَسُولَ اللهِ ﷺ جِيءَ فِي رَجُلٍ تَرَكَ ابْنَتَهُ وَأُخْتَهُ فَأَعْطَى الِابْنَةَ النِّصْفَ وَالْأُخْتَ النِّصْفَ كَذَا
الترجمة الإنجليزية
Abu Abdullah al-Hafiz and Abu Sa'id informed us: Abu al-Abbas Muhammad ibn Ya'qub narrated to us: Yahya ibn Abi Talib narrated to us: Yazid ibn Harun informed us: Shu'bah narrated from Abu Qays from Huzayl ibn Shurahbil who said: Umar ibn al-Khattab said to Abu Musa: What did Allah's Messenger judge regarding a daughter, granddaughter, and sister? Abu Musa replied: The daughter gets one-half and the sister gets one-half. Go to Ibn Mas'ud. When asked, Ibn Mas'ud said: I would be in error if I judged differently from the Prophet (peace be upon him), who gave the daughter one-half, the granddaughter one-sixth to complete two-thirds, and the remainder to the sister.
