أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو أنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ح وَأَخْبَرَنَا أَبُو بَكْرٍ الْفَارِسِيُّ أنا إِسْمَاعِيلُ الْخَلَّالِيُّ أنا أَبُو يَعْلَى قَالَا ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ أَنَّ مَعَانِيَ هَذِهِ الْفَرَائِضِ وَأُصُولَهَا عَنْ زَيْدِ بْنِ ثَابِتٍ وَأَمَّا التَّفْسِيرُ فَتَفْسِيرُ أَبِي الزِّنَادِ عَلَى مَعَانِي زَيْدٍ قَالَ وَمِيرَاثُ الْأُمِّ مِنْ وَلَدِهَا إِذَا تُوُفِّيَ ابْنُهَا وَابْنَتُهَا فَتَرَكَ وَلَدًا أَوْ وَلَدَ ابْنٍ ذَكَرًا أَوْ أُنْثَى أَوْ تَرَكَ الِاثْنَيْنِ مِنَ الْإِخْوَةِ فَصَاعِدًا ذُكُورًا أَوْ إِنَاثًا مِنْ أَبٍ وَأُمٍّ أَوْ مِنْ أَبٍ أَوْ مِنْ أُمٍّ السُّدُسُ فَإِنْ لَمْ يَتْرُكِ الْمُتَوَفَّى وَلَدًا وَلَا وَلَدَ ابْنٍ وَلَا اثْنَيْنِ مِنَ الْإِخْوَةِ فَصَاعِدًا فَإِنَّ لِلْأُمِّ الثُّلُثَ كَامِلًا إِلَّا فِي فَرِيضَتَيْنِ فَقَطْ وَهُمَا أَنْ يُتَوَفَّى رَجُلٌ وَيَتْرُكَ امْرَأَتَهُ وَأَبَوَيْهِ فَيَكُونَ لِامْرَأَتِهِ الرُّبُعُ وَلِأُمِّهِ الثُّلُثُ مِمَّا بَقِيَ وَهُوَ الرُّبُعُ مِنْ رَأْسِ الْمَالِ وَإِنْ تُتَوَفَّى امْرَأَةٌ وَتَتْرُكْ زَوْجَهَا وَأَبَوَيْهَا فَيَكُونَ لِزَوْجِهَا النِّصْفُ وَلِأُمِّهَا الثُّلُثُ مِمَّا بَقِيَ وَهُوَ السُّدُسُ مِنْ رأْسِ الْمَالِ

Abu Sa'id ibn Abi Amr informed us: Abu Abdullah ibn Ya'qub narrated to us: Muhammad ibn Nasr narrated to us. And Abu Bakr al-Farisi informed us: Isma'il al-Khallali informed us: Abu Ya'la narrated to us. Both narrated from Muhammad ibn Bakkar: Abd al-Rahman ibn Abi al-Zinad narrated from his father from Kharijah ibn Zayd ibn Thabit: The meanings of these laws of inheritance and their principles are from Zayd ibn Thabit, while the commentary is the interpretation of Abu al-Zinad based on the meanings of Zayd. He said: The inheritance of the mother from her child: if her son or daughter dies leaving a child or grandchild, male or female, or leaving two or more siblings, whether male or female, full or paternal or maternal, the mother gets one-sixth. If the deceased left no child, no grandchild, and no two or more siblings, then the mother gets the full one-third, except in two specific cases only: if a man dies leaving his wife and both parents, the wife gets one-quarter, and the mother gets one-third of the remainder, which is one-quarter of the total estate. And if a woman dies leaving her husband and both parents, the husband gets one-half, and the mother gets one-third of the remainder, which is one-sixth of the total estate.
