وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى ثنا يَزِيدُ أنا حَبِيبُ بْنُ أَبِي حَبِيبٍ عَنْ عَمْرِو بْنِ هَرِمٍ عَنْ جَابِرِ بْنِ زَيْدٍ قَالَ أَيُّمَا رَجُلٍ قَت��لَ رَجُلًا أَوِ امْرَأَةً عَمْدًا أَوْ خَطَأً مِمَّنْ يَرِثُ فَلَا مِيرَاثَ لَهُ مِنْهُمَا وَأَيُّمَا امْرَأَةٍ قَتَلَتْ رَجُلًا أَوِ امْرَأَةً عَمْدًا أَوْ خَطَأً فَلَا مِيرَاثَ لَهَا مِنْهُمَا وَإِنْ كَانَ الْقَتْلُ عَمْدًا فَالْقَوَدُ إِلَّا أَنْ يَعْفُوا أَوْلِيَاءُ الْمَقْتُولِ فَإِنْ عَفَوْا فَلَا مِيرَاثَ لَهُ مِنْ عَقْلِهِ وَلَا مِنْ مَالِهِ قَضَى بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ وَعَلِيٌّ ؓ وَشُرَيْحٌ وَغَيْرُهُمْ مِنْ قُضَاةِ الْمُسْلِمِينَ
الترجمة الإنجليزية
Abu Abdullah informed us: Abu al-Abbas narrated to us: Yahya narrated to us: Yazid informed us: Habib ibn Abi Habib narrated from Amr ibn Harim from Jabir ibn Zayd who said: Any man who kills a man or a woman intentionally or accidentally from those he would inherit from, there is no inheritance for him from either. And any woman who kills a man or a woman intentionally or accidentally, there is no inheritance for her from either. If the killing was intentional, retaliation is required unless the relatives of the killed one pardon. If they pardon, there is no inheritance for the killer from the blood money or from the estate. This was the judgment of Umar ibn al-Khattab, Ali (may Allah be pleased with them), Shurayh, and other Muslim judges.
