اسْتِدِلَالًا بِمَا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا الشَّافِعِيُّ أنا ابْنُ عُيَيْنَةَ عَنِ الزُّهْرِيِّ عَنْ سَالِمِ بْنِ عَبْدِ اللهِ عَنْ أَبِيهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَهُ الْمُبْتَاعُ قَالَ الشَّافِعِيُّ فَلَمَّا كَانَ بَيِّنًا فِي سُنَّةِ النَّبِيِّ ﷺ أَنَّ الْعَبْدَ لَا يَمْلِكُ مَالًا وَأَنَّ مَا يَمْلِكُ الْعَبْدُ فَإِنَّمَا يَمْلِكُهُ سَيِّدُهُ وَلَمْ يَكُنِ السَّيِّدُ بِأَبِي الْمَيِّتِ وَلَا وَارِثٍ سُمِّيَتْ لَهُ فَرِيضَةٌ فَكُنَّا لَوْ أَعْطَيْنَا الْعَبْدَ بِأَنَّهُ أَبٌ إِنَّمَا أَعْطَيْنَا السَّيِّدَ الَّذِي لَا فَرِيضَةَ لَهُ فَوَرَّثْنَا غَيْرَ مَنْ وَرَّثَ اللهُ فَلَمْ نُوَرِّثْ عَبْدًا لِمَا وَصَفْتُ وَلَا أَحَدًا لَمْ يَجْتَمِعْ فِيهِ الْحُرِّيَّةُ وَالْإِسْلَامُ وَالْبَرَاءَةُ مِنَ الْقَتْلِ قَالَ الشَّيْخُ وَبِهِ قَالَ زَيْدُ بْنُ ثَابِتٍ
الترجمة الإنجليزية
As evidence, Abu Abdullah al-Hafiz informed us: Abu al-Abbas Muhammad ibn Ya'qub informed us: al-Rabi' ibn Sulayman informed us: al-Shafi'i informed us: Ibn Uyaynah narrated from al-Zuhri from Salim ibn Abdullah from his father that the Messenger of Allah (peace be upon him) said: Whoever sells a slave who has wealth, the wealth belongs to the seller unless the buyer stipulates it. Al-Shafi'i said: Since it is clear from the Sunnah of the Prophet (peace be upon him) that a slave does not own wealth, and whatever the slave possesses actually belongs to his master, and the master is neither the father of the deceased nor an heir with a designated share - if we gave the slave an inheritance on the basis that he is a father, we would actually be giving the master who has no designated share, thus granting inheritance to someone other than whom Allah designated. Therefore, we do not give inheritance to a slave for the reason described, nor to anyone who does not combine freedom, Islam, and innocence of murder. The Shaykh said: This was also the view of Zayd ibn Thabit.
