عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَا يَسُومُ أَحَدُكُمْ عَلَى سَوْمِ أَخِيهِ فَإِنْ كَانَ ثَابِتًا وَلَسْتُ أَحْفَظُهُ ثَابِتًا فَهُوَ مِثْلَ لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ وَلَا يَسُومُ عَلَى سَوْمِهِ إِذَا رَضِيَ الْبَائِعُ وَأَذِنَ بِأَنْ يُبَاعَ قَبْلَ الْبَيْعِ حَتَّى لَوْ بِيعَ لَزِمَهُ قَالَ وَرَسُولُ اللهِ ﷺ بَاعَ فِيمَنْ يَزِيدُ وَبَيْعُ مَنْ يَزِيدُ سَوْمُ رَجُلٍ عَلَى سَوْمِ أَخِيهِ وَلَكِنَّ الْبَائِعَ لَمْ يَرْضَ السَّوْمَ الْأَوَّلَ حَتَّى طَلَبَ الزِّيَادَةَ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ فَذَكَرَهُ قَالَ الشَّيْخُ حَدِيثُ السَّوْمِ قَدْ ثَبَتَ مِنْ أَوْجُهٍ al-Shāfiʿī ؒ Fī Kitāb al-Risālah And Qad Ruwī
الترجمة الإنجليزية
The Prophet (peace be upon him) said: "None of you should bid over the bid of his brother." Al-Shafi'i explained: This is like the prohibition against proposing over a brother's proposal — it applies when the seller has agreed and authorized the sale. Yet the Messenger of Allah sold by auction, and auction is bidding over a brother's bid, but in that case the seller had not accepted the first bid and was seeking a higher price.
