حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ حَدَّثَنَا مُحَمَّدٌ يَعْنِي ابْنَ رَاشِدٍ عَنْ سُلَيْمَانَ يَعْنِي ابْنَ مُوسَى عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ كُلَّ مُسْتَلْحَقٍ يُسْتَلْحَقُ بَعْدَ أَبِيهِ الَّذِي يُدْعَى لَهُ ادَّعَاهُ وَرَثَتُهُ مِنْ بَعْدِهِ فَقَضَى إِنْ كَانَ مِنْ أَمَةٍ يَمْلِكُهَا يَوْمَ أَصَابَهَا فَقَدْ لَحِقَ بِمَنْ اسْتَلْحَقَهُ وَلَيْسَ لَهُ فِيمَا قُسِمَ قَبْلَهُ مِنْ الْمِيرَاثِ شَيْءٌ وَمَا أَدْرَكَ مِنْ مِيرَاثٍ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يُلْحَقُ إِذَا كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ وَإِنْ كَانَ مِنْ أَمَةٍ لَا يَمْلِكُهَا أَوْ مِنْ حُرَّةٍ عَاهَرَ بِهَا فَإِنَّهُ لَا يُلْحَقُ وَلَا يَرِثُ وَإِنْ كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ هُوَ الَّذِي ادَّعَاهُ وَهُوَ وَلَدُ زِنًا لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً.
الترجمة الإنجليزية
Hashim ibn al-Qasim told us: Muhammad - that is, Ibn Rashid - told us, from Sulayman - that is, Ibn Musa - from Amr ibn Shu'ayb, from his father, from his grandfather, that the Messenger of Allah, peace and blessings be upon him, ruled that whoever is acknowledged as a son after the death of the father to whom he is attributed, and the father's heirs after him lay claim to him: he ruled that if he was born of a slave-woman the father owned at the time he had relations with her, he is joined to the one who acknowledges him, but has no share in what was already divided of the inheritance before that; and whatever inheritance he catches that has not yet been divided, he has his share of it. But he is not to be joined if the father to whom he is attributed had denied him. And if he was born of a slave-woman the father did not own, or of a free woman with whom he committed fornication, then he is not to be joined and does not inherit, even if the father to whom he is attributed is the one who acknowledged him - he is a child of fornication belonging to his mother's people, whether they were free or slaves.
