حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ وَعَبْدُ اللَّهِ بْنُ بَكْرٍ قَالَا حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ يُونُسَ بْنِ جُبَيْرٍ أَنَّهُ سَأَلَ ابْنَ عُمَرَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ أَتَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ بِذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ إِنْ بَدَا لَهُ طَلَاقُهَا طَلَّقَهَا فِي قُبُلِ عِدَّتِهَا قَالَ ابْنُ بَكْرٍ أَوْ فِي قُبُلِ طُهْرِهَا فَقُلْتُ لِابْنِ عُمَرَ أَيُحْسَبُ طَلَاقُهُ ذَلِكَ طَلَاقًا قَالَ نَعَمْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ.
الترجمة الإنجليزية
Muhammad ibn Ja'far and Abdullah ibn Bakr narrated to us, they said: Sa'id narrated to us, from Qatadah, from Yunus ibn Jubayr, that he asked Ibn Umar about a man who divorced his wife while she was menstruating. He said: Do you know Abdullah ibn Umar? He divorced his wife while she was menstruating, so Umar went to the Messenger of Allah, peace and blessings be upon him, and informed him of that, and the Messenger of Allah, peace and blessings be upon him, said: Order him to take her back, then if he wishes to divorce her afterward, let him divorce her at the beginning of her waiting period (Ibn Bakr said: or at the beginning of her purity). I said to Ibn Umar: Is that divorce counted as a valid divorce? He said: Yes — what do you think if he had been incapable and foolish (would it not still count)?
