حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ أَخْبَرَنِي عَطَاءُ بْنُ يَزِيدَ اللَّيْثِيُّ ثُمَّ الْجُنْدُعِيُّ أَنَّ عُبَيْدَ اللَّهِ بْنَ عَدِيِّ بْنِ الْخِيَارِ أَخْبَرَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ وَكَانَ حَلِيفًا لِبَنِي زُهْرَةَ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخْبَرَهُ أَنَّهُ قَالَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنْ الْكُفَّارِ فَاقْتَتَلْنَا فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ فَقَالَ أَسْلَمْتُ لِلَّهِ أَأَقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أَنْ قَالَهَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا تَقْتُلْهُ قَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قَطَعَ إِحْدَى يَدَيَّ ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا تَقْتُلْهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ.

Ya'qub narrated to us: the nephew of Ibn Shihab narrated to us from his uncle: Ata' ibn Yazid al-Laythi, then al-Jundu'i, informed me that Ubaydullah ibn Adiyy ibn al-Khiyar informed him that al-Miqdad ibn Amr al-Kindi -- who was an ally of Banu Zuhrah and was among those who witnessed Badr with the Messenger of Allah, peace and blessings be upon him -- informed him that he said to the Messenger of Allah, peace and blessings be upon him: "What do you think if I meet a man among the disbelievers and we fight, and he strikes off one of my hands with the sword and cuts it off, then he takes refuge from me by a tree and says, 'I have submitted to Allah' -- should I kill him, O Messenger of Allah, after he has said it?" The Messenger of Allah, peace and blessings be upon him, said: "Do not kill him." He said: "O Messenger of Allah, he cut off one of my hands, then said that after he had cut it off!" The Messenger of Allah, peace and blessings be upon him, said: "Do not kill him, for he is in your position before you kill him, and you are in his position before he said the word he said."
