He said: Yahya ibn Adam told us, Zuhayr and Ibn Idris told us, from Muhammad ibn Ishaq, from Yazid ibn Abi Habib, from Ma'mar ibn Abi Habibah, from 'Ubayd ibn Rifa'ah ibn Rafi', from his father -- Zuhayr said in his hadith: Rifa'ah ibn Rafi', and he had witnessed 'Aqabah and Badr -- who said: I was with 'Umar when it was said to him: "Zayd ibn Thabit is giving legal rulings to people in the mosque" -- Zuhayr said in his hadith: "giving rulings to people by his own opinion" -- regarding the one who has intercourse but does not ejaculate. 'Umar said: "Hurry and bring him." So he was brought, and 'Umar said: "O enemy of yourself, have you gone so far as to give legal rulings to people in the mosque of the Messenger of Allah, peace and blessings be upon him, by your own opinion?" He said: "I did not do that, but my paternal uncles related to me from the Messenger of Allah, peace and blessings be upon him." He said: "Which of your uncles?" He said: "Ubayy ibn Ka'b" -- Zuhayr said: "and Abu Ayyub and Rifa'ah ibn Rafi'." I turned to see what this young man was saying -- and Zuhayr said: "what this lad was saying" -- and I said: "We used to do it in the time of the Messenger of Allah, peace and blessings be upon him." He said: "Did you then ask the Messenger of Allah, peace and blessings be upon him, about it?" He said: "We used to do it in his time and would not perform the full ritual bath." He said: So he gathered the people, and the people agreed that water is not required except from water, except two men: 'Ali ibn Abi Talib and Mu'adh ibn Jabal, who said: "When the circumcised part passes the circumcised part, ghusl becomes obligatory." Then 'Ali said: "O Commander of the Believers, the most knowledgeable people about this are the wives of the Messenger of Allah, peace and blessings be upon him." So he sent to Hafsah, and she said: "I have no knowledge of it." He sent to 'A'ishah, and she said: "When the circumcised part passes the circumcised part, ghusl becomes obligatory." 'Umar became furious, that is, angry, then he said: "Let it not reach me that anyone has done it and not performed ghusl, or I will inflict severe punishment on him." 'Abdullah told us, Abu Bakr ibn Abi Shaybah told us, 'Abd al-A'la ibn 'Abd al-A'la told us, from Muhammad ibn Ishaq, from Yazid ibn Abi Habib, from Ma'mar ibn Habibah, from 'Ubayd ibn Rifa'ah ibn Rafi', from his father, and he mentioned the like of it and its meaning.
